Diagnoses, tests, studies or analyses for the diagnosis of a disease or disability and care and treatment by a hospital, as defined in Article 28 of the Public Health Law, or by a physician or by a dentist to inmates of a County correctional facility which are provided by the County shall be available without cost or charge to the inmates receiving such examinations, care or treatment.
Notwithstanding the foregoing provisions of this article, the Commissioner of Health Services is hereby authorized, empowered and directed to seek reimbursement for costs paid pursuant to § 33-4 of this chapter from any third-party coverage or indemnification carried by an inmate. Any such third-party coverage or indemnification recovered shall first be applied against the total cost to the hospital or other provider as established in accordance with the provisions of § 2807 of the Public Health Law relating to rates of payment of an individual's care and treatment, as provided herein.
The Commissioner of Health Services shall promulgate regulations necessary to carry out the provisions of this article.
