For purposes of this article only, the following terms shall
be defined as set forth:
A person who, for compensation or hire, engages in the carriage
by aircraft in air commerce of persons or property, other than as
an air carrier or foreign air carrier or under the authority of 14
CFR Part 375. Where it is doubtful that an operation is for "compensation
or hire," the test applied is whether the carriage by air is merely
incidental to the person's other business or is, in itself, a major
enterprise for profit.
Any privately owned aircraft not for hire which is operated
by an owner or lessee, used for purposes of business or pleasure for
which use no compensation is sought or received.

All fees are to be implemented pursuant to the rules and regulations
as determined by the Department of Economic Development.
Such fees shall be payable by the operator of any aircraft landing
at the airport, except for aircraft operated by a lessee of County-owned
airport property or a sublessee or tenant of a lessee of County-owned
airport property, or unless otherwise provided for in an agreement
with the County.
The following aircraft shall be exempt from the imposition of
landing fees: any aircraft actively in the service of any federal,
state, or local government agency or any aircraft operating in connection
with a medical, military or civil defense emergency.
