The purpose of this chapter is to provide for the safety, enjoyment, health, and welfare of all persons using the public beach and parking facilities at Weirs Beach, to further provide a means of maintenance, operation and protection of the public beach and parking area, and to provide a family-oriented atmosphere at an environmentally friendly and enjoyable public beach for residents and land owners of Laconia and their accompanied guests. This chapter is adopted pursuant to Sections 3:06 and 3:07 of the Laconia City Charter.
A. 
Applicability. This chapter shall apply to City-owned property at Weirs Beach which includes a beach and parking area.
B. 
Effective date. This chapter shall take effect upon adoption by the Laconia City Council.
As used in this chapter, the following terms shall have the meanings indicated:
CITY
The City of Laconia, New Hampshire.
BEACH
The property owned by the City of Laconia known as Weirs Beach.
A. 
Regular opening and closing dates for swimming shall be established by the Parks and Recreation Commission and approved by the City Council.
B. 
Hours. The beach area shall be open during the designated hours established by the Parks and Recreation Commission and approved by the City Council.
C. 
Capacity. At no time shall there be permitted more than 2,200 people on the beach.
D. 
Picnicking. Picnicking is allowed.
E. 
Fires. Fires shall be confined to appropriate receptacles. Propane tanks in excess of five pounds are prohibited.
F. 
Offensive behavior. No person shall engage in any indecent language or loud noise which would be offensive to any reasonable person or engage in any disorderly conduct or behavior tending to breach the public peace. Such behavior can result in expulsion.
G. 
Children under 12 years of age must be accompanied by someone 16 years of age or older.
First time and minor violations of this chapter not involving any property damage, injury, or cost to the City will be enforced by means of a warning issued by an enforcement officer as described under § 227-6. Subsequent violations, or violations that result in any property damage, injury to others, or any costs to the City, may result in more formal enforcement proceedings, whereby a complaint will be filed on behalf of the City before a court of competent jurisdiction. Any person found in violation of this chapter by a court of competent jurisdiction shall be subject to a fine payable to the City of Laconia of not more than $100.
This chapter may be enforced by the Police Chief, Fire Chief and/or Director of Recreation and Facilities, and/or their designees.
