§ K-101 Zoning, Prior Ordinances.

11-1. Zoning the Borough of Fox Chapel in the County of Allegheny, Pennsylvania; restricting and regulating the location, construction and use of buildings, the area of yards, courts and other open spaces, and the use of land; conferring certain powers upon a Building Inspector; providing for appeals; and imposing fines and penalties. [Ord. 9, 4/8/1935] (This ordinance was superseded by Ord. 35, Section 5 of Article XIII of which provided as follows: "The 'Fox Chapel Zoning Ordinance of 1935' shall continue in full force and effect, except insofar as its provisions may conflict with the provisions of this amendment. Any provisions of said Ordinance . . . are hereby repealed so far as they affect this amendment." The enacting clause of the present Zoning Ordinance [Ord. 319, Sections 1 to 124 of Chapter XXVII] stated that that ordinance was also an amendment, revision and reenactment of this ordinance. It is doubtful whether any provision of this ordinance is still in effect. However, this ordinance, and those listed below, are still of interest because it is often necessary to determine whether existing uses, entered into prior to the effective date of the current zoning ordinance, are lawful nonconforming uses, or unlawful uses.)
11-2. Fox Chapel Zoning Amendment of 1938. [Ord. 35, 3/8/1938] (This was a complete amendment and revision of the Zoning Ordinance of 1935, Section 11-1, above.)
11-3. Fox Chapel Zoning Ordinance Amendment of 1938. [Ord. 43, 5/20/1939] (This changed the classification of a tract of land from Class C Residence District to Class B Residence District.)
11-4. Amending Ordinance No. 35 entitled Amendment to Ordinance No. 9 [Ord. 50, 3/20/1940] (This made changes in the regulations applicable to the "A", "B", and "C" Residence Districts and to certain general provisions of the basic zoning ordinance.)
11-5. Amending Ord. Nos. 50, 35, and 9 and zoning certain territory admitted and annexed to the Borough. [Ord. 60, 9/11/1942] (This zoned territory annexed by Ord. 51 [Section 2-1, above] as Class B Residence District.)
11-6. Amendment to Ordinance No. 9. . . . [Ord. 69, 9/11/1945] (This zoned the territory annexed by Ord. 65 [Sections 2-2, above] as Class D Residence District and made changes in the regulations applicable to that District.)
11-7. Amending Ordinance 35, Fox Chapel Zoning Ordinance, changing certain property now or late of H. Rey Helveston and Frederick C. McKee from Class A Residence to Class B Residence. [Ord. 72, 12/4/1946]
11-8. Amending Ordinances 50, 35 and 9 pertaining to zoning of certain territory admitted and annexed to Borough, restricting and regulating location, construction and use of buildings, area of yards, conferring certain powers upon building inspector, providing for appeals, and imposing fines and penalties. [Ord. 85, 8/8/1949] (This zoned the territory annexed by Ordinance 75 [Section 2-3, above] as Class C Residence.)

Amending Ordinances 50, 35 and 9 pertaining to zoning of certain territory admitted and annexed to Borough, restricting and regulating location, construction and use of buildings, area of yards, conferring certain powers upon building inspector, providing for appeals, and imposing fines and penalties. [Ord. 86, 8/8/1949] (This zoned the territory annexed by Ord. 76 [Section 2-4, above ] as Class C Residence.)
11-10. Amending Ordinances 50, 35 and 9 pertaining to zoning of certain territory admitted and annexed to Borough, restricting and regulating location, construction and use of buildings, area of yards, conferring certain powers upon building inspector, providing for appeals, and imposing fines and penalties. [Ord. 87, 8/8/1949] (This zoned the territory annexed by Ordinance 77 [Section 2-5, above] as Class D Residence.)
11-11. Amending Ordinances 50, 35 and 9 pertaining to zoning of certain territory admitted and annexed to Borough, restricting and regulating location, construction and use of buildings, area of yards, conferring certain powers upon building inspector, providing for appeals, and imposing fines and penalties. [Ord. 88, 8/8/1949] (This zoned the territory annexed by Ordinance 78 [Section 2-6, above] as Class C Residence.)
11-12. Amending Ordinances 50, 35 and 9 pertaining to zoning of certain territory admitted and annexed to Borough, restricting and regulating location, construction and use of buildings, area of yards, conferring certain powers upon building inspector, providing for appeals, and imposing fines and penalties. [Ord. 89, 8/8/1949] (This zoned the territory annexed by Ordinance 83 [Section 2-7, above] as "C" Residence District.)
11-13. Amending Ordinance Nos. 89, 88, 87, 86, 50, 35 and 9. [Ord. 103, 5/15/1951] (This added provisions on minimum first-floor area for single-family dwellings.)
11-14. Amending Ordinance Nos. 50, 35 and 9 pertaining to zoning of certain territory admitted and annexed to the Borough, restricting and regulating location, construction and use of buildings, area of yards, conferring certain powers upon building inspector, providing for appeals and imposing fines and penalties. [Ord. 104, 5/14/1951] (This zoned the territory annexed by Ord. 100 [Section 2-8, above] as Class A Residence.)

Zoning Ordinance. [Ord. 104-A, 6/14/1951] (This made changes in the regulations applicable in "D" Residence Districts.)
11-16. Amending Ordinance 9 — 
Zoning Ordinance. [Ord. 135, 3/14/1995] (This zoned the territory annexed by Ordinance 120 [Section 2-9, above] as Class C Residence.)
11-17. Amending Ordinance 9, as amended by Ordinances 35, 50 and other ordinances pertaining to zoning, establishing building lines in Class C Residence Districts and repealing provisions of ordinances inconsistent there-with. [Ord. 140, 6/13/1955] (This changed the lot area and building location provisions in "C" Residence Districts.)
11-18. Amending Nos. 9 and 35 and 50 as amended, rezoning land within the Borough and providing for an amendment to the Borough Zoning Map. [Ord. 153, 8/13/1956] (This rezoned from B Residence to C Residence the land bounded by the Fox Chapel Manor Plan on the south, Fox Chapel Road on the west, lands of the Fox Chapel Presbyterian Church and of Babcock Lott Enterprises on the north, and lands of Margaret Donnelly and Richard Wetzig et ux. on the east.)
11-19. Amending Ordinance No. 98 by rezoning a portion of land from C Residence District to B Residence District. [Ord. 155, 11/19/1956] (This rezoned part of the territory annexed by Ordinance 89 [Section 2-7, above].)
11-20. Amending Section 104-A approved June 14, 1951. [Ord. 201, 10/20/1958] (This added a provision requiring conformity to building lines in "D" Residence Districts.)
11-21. Amending Ordinance No. 35 known as "Fox Chapel Zoning Ordinance Amendment of 1938" as subsequently amended by changing certain property now or late of Children's Hospital of Pittsburgh from D Residence District to A Residence District. [Ord. 225, 1/21/1960]
11-22. Amending Ordinance No. 35, known as "Fox Chapel Zoning Ordinance Amendment of 1938," as amended, to provide for the approval of the use of lands in "A" Residence Districts on a density development plan, by the Board of Adjustment; and defining and setting standards for, and specifying factors to be considered by the Board of Adjustment in approving the use of, density development. [Ord. 259, 9/23/1964]
11-23. Amending Ordinance No. 35 known as "Fox Chapel Zoning Ordinance Amendment of 1938" as subsequently amended by increasing setback distances from side and rear lot lines in "A" and "B" Residence Districts, establishing setback distances from parks, eliminating "E" Business Districts and changing or eliminating certain procedural provisions. [Ord. 277, 6/20/1966]
