The Town Board of the Town of Smithtown hereby advises and declares it to be in the best interest of the citizens of the Town of Smithtown to create and provide for the appointment of a Historical Advisory Board to advise and recommend to the Town Board such policies and programs which may aid the Town Board in its policy-making decisions regarding Smithtown's historical, cultural and architectural heritage.
The Board shall be known as the "Historical Advisory Board of the Town of Smithtown" and shall consist of six members, who shall be appointed by the Town Board for terms not exceeding two years, and the Town Historian, who shall serve as an ex officio member. The Chairman of the Board shall be designated by the Town Board from among the members so appointed to the Board. The members appointed shall be eligible for reappointment, shall be qualified by reason of special interest, knowledge or training in such fields as history, architecture or other like fields of special knowledge or interest and shall be residents of the Town of Smithtown.
The Historical Advisory Board shall be charged with the following responsibilities and duties:
A. 
To serve as an advisory board to the Town of Smithtown Town Board and to meet upon request of the Town Board, Town Historian and/or the Chairman of the Historical Advisory Board to discuss any matter of importance relating to the preservation of the historical, architectural and cultural heritage.
B. 
To discuss, find and advise the Town Board of the Town of Smithtown on a course of action regarding these matters.
C. 
To present written recommendations for the Town Board members to consider when making final determinations involving these matters.
D. 
To serve as the guardians of any historical items that have been or will be donated to the Town of Smithtown by its citizenry.
E. 
To safeguard these items in the public interest by depositing them in a Town building designated by the Town Board as an historical depository.
The members of the Historical Advisory Board of the Town of Smithtown shall serve without compensation. The Town Board, however, may appropriate in the annual budget of the Town a sum of money for the purpose of providing to the Historical Advisory Board funds to defray the cost or expenses incurred by it in the performance of its duties as hereinabove set forth. Such appropriations shall be a charge upon the taxable property of that part of the Town of Smithtown outside the incorporated villages contained therein.
