As used in this chapter, the following terms shall have the meanings indicated:
GARAGE SALE
All general sales open to the public conducted from or on a residential premises for the purpose of disposing, by sale, barter or otherwise, of personal property, including but not limited to all sales entitled "garage," "lawn," "yard," "attic," "porch," "room," "backyard," "patio," "flea market," "rummage sales" or "auctions." This definition shall not include a situation where no more than five specific items are held out for sale and all advertisements of such sales specifically name those items to be sold.
PERSON
Includes natural persons, corporations, charitable or religious institutions or nonprofit corporations, homeowners' associations, unincorporated associations and family groups.
PERSONAL PROPERTY
Property which is owned, utilized and maintained by an individual or members of his or her residence and acquired in the normal course of living or in maintaining a residence.
A garage or yard sale can be conducted between the hours of 8:00 a.m. and 7:00 p.m. Monday through Sunday.
A garage or yard sale can only be licensed to and conducted by the registered owner of the premises for which the license is issued.

A. 
The registered owner of a property and occupants of the premises may have two garage or yard sales per year. Each sale may not consist of more than two consecutive days.
B. 
The Mayor and Council may designate one day a year when all registered property owners and occupants of the premises may conduct a garage sale on the same date. All registered property owners and occupants of the premises shall be entitled to conduct a garage sale on that date even if they had previously utilized the two-sale limitation.

Garage or yard sales are not permitted on the premises of apartment complexes unless permitted by the apartment complex owner.

A garage or yard sale sign must be placed or erected between the curb line and the sidewalk.
All articles, tables, displays, racks, etc., must be set back at least 10 feet from the curb or highway.
A. 
A garage or yard sale or flea market must be conducted in a neat and orderly fashion.
B. 
Small articles or objects must be displayed on tables.
C. 
Clothing and wearing apparel must be displayed on racks or tables.
All garage or yard sales or flea markets cannot impede or disrupt motoring traffic or neighborhood parking.
All garage or yard sale items, tables, displays and signs must be removed from the premises at the end of each sale day.
No food or beverages may be sold or offered free at a yard or garage sale.
No hawking or sound device, recording system or public address system can be used at a garage or yard sale.

The fee for a garage sale license shall be $5. Any bona fide charitable, educational, cultural or governmental institution or organization may apply to the Mayor and Council for an exemption from the filing fee. There shall be no fee for a sale conducted on the date of the town-wide sale.

Any person who violates the provisions of this chapter shall be punishable as provided in Chapter 1, Article II, General Penalty, of the Code of the Borough of Wallington.
