No person shall sell or deliver or have in his possession for sale or delivery in the Borough of Wallington any milk or fluid milk products without first obtaining from this Board a license for such sale or delivery.
Each license granted under the portions of this article shall expire on the last day of December following the granting of the same.
A. 
Whenever, in the opinion of this Board, the public health is seriously jeopardized, the Health Officer and Sanitary Inspector shall have the power temporarily to order that any supply of milk, milk products or fluid milk products shall not be sold, delivered or had in possession for sale or delivery in the Borough of Wallington.
B. 
Any person licensed to sell or deliver, produce or handle milk, milk products or fluid milk products in the Borough of Wallington shall, upon notification by this Board or its Health Officer, immediately withdraw any source of his milk, milk products or fluid milk products not produced, handled or distributed in compliance with the provisions of this article.
Upon each wagon or other vehicle used in the sale or delivery of milk, milk products or fluid milk products there shall be displayed at all times in plain sight a current license sign furnished by this Board.

The license fees shall be paid before any license or license sign is issued, as required by this article. The fee shall be as set forth in § 396-10.
No milk or fluid milk products shall be sold or delivered in the Borough of Wallington unless the same have been pasteurized.
Inspections of any premises where milk, milk products or fluid milk products, any part of which is sold in the Borough of Wallington, are produced, handled, stored or distributed shall be permitted to an authorized agent of this Board at any reasonable hour.[1]

Any person who shall be found guilty of violating this article shall be subject to a penalty as set forth in Article XI, Violations and Penalties, of this chapter.
