The Sheriff of Suffolk County is hereby authorized and empowered to execute applications with the United States Department of Justice and with the United States Department of the Treasury for the transfer of federally seized and forfeited property.
The Sheriff of Suffolk County is hereby authorized and empowered to receive and utilize such assets in accordance with the terms, conditions and provisions of the Comprehensive Crime Control Act of 1984 and the United States Attorney General's Guidelines on Seized and Forfeited Property.
The receipt of said funds may be credited and then appropriated via pro forma resolutions and expended in accordance with the County Department of Audit and Control's Procedures Manual for the Receipt and Disbursement of Forfeiture Funds, in accordance with all applicable local laws, rules and regulations and within the terms, conditions and provisions of the Comprehensive Crime Control Act of 1984 and the United States Attorney General's Guidelines on Seized and Forfeited Property.
A. 
The Suffolk County Department of Audit and Control, or any successor department thereto, shall examine, audit and verify all books, records and accounts kept by the Suffolk County Sheriff, pertaining to County forfeiture funds, and shall provide a written determination of the regularity, legality and correctness of appropriations and/or expenditures made in connection with such funds to the County Executive and to each member of the County Legislature no later than May 31 of each year.

B. 
This report shall include but not be limited to a detailed accounting as to under which statute such moneys and/or assets were received; whether or not and to what extent such moneys and/or assets were appropriated by the County Legislature; what percentage of such forfeited assets and/or moneys was kept by the County of Suffolk, federal government and/or state government; the County agencies to which the local share of such forfeited assets or moneys were allocated; and a detailed itemization of the expenditure of the County portion of such forfeited funds and/or assets and the local County agencies through which such expenditures were made.
The effective date of this article shall be retroactive to the date funds were initially received on behalf of the Sheriff's Office from the United States Department of Justice and/or the United States Department of the Treasury.
