These regulations are adopted under the authority granted by
§ 236.45, Wis. Stats., and pursuant to §§ 62.23
and 281.31, Wis. Stats.
A.
In their interpretation and application, the provisions of this chapter
shall be held to the minimum requirements for the promotion of the
public health, safety, morals, and welfare and shall be interpreted
as set forth herein.
B.
No subdivision of land shall hereinafter be made for any purpose
or in any manner whatsoever within areas included within the jurisdiction
of this chapter unless it shall be in full compliance with the terms
and provisions of this chapter and other applicable regulations.
This chapter supersedes provisions of any ordinance relating
to subdivisions only as set forth herein. Any other applicable administrative
codes or ordinances shall remain in full force and effect to the extent
that their provisions are more restrictive. It is not otherwise intended
by this chapter to repeal, abrogate, or impair any existing ordinance
restrictions; however, where this chapter imposes greater restrictions
the provisions of this chapter shall prevail.
A.
Where the conditions imposed by any provision of this chapter are
either more restrictive or less restrictive than comparable conditions
imposed by other law, ordinance, statute, resolution, or regulation
of any kind, the regulations which are more restrictive or which impose
higher standards or requirements shall prevail. No land shall be subdivided
or used for any purpose or in any manner which is not in conformity
with the provisions of this chapter.
B.
It is hereby declared to be the intention of the Council that the
several provisions of this chapter are separable in accordance with
the following:
(1)
If any court of competent jurisdiction shall adjudge any provision
of this chapter to be invalid, such judgment shall not affect any
other provisions of this chapter not specifically included in said
judgment.
(2)
If any court of competent jurisdiction shall adjudge invalid the
application of any provision of this chapter to a particular property,
building, or other structure, such judgment shall not affect the application
of said provision to any other property, building or structure not
specifically included in said judgment.
The jurisdiction of this chapter includes all lands within the
corporate limits of the City of New Lisbon.
No parcel of land shall hereafter be subdivided or altered unless
in compliance with the provisions of the applicable portions of this
chapter and the applicable provisions of the Wisconsin Statutes and
Administrative Code and unless it is in strict compliance with the
plans approved by the City for said subdivision.
Nothing herein contained shall require any change in the plans
for the subdivision of a parcel which has been approved before the
effective date of this chapter and the development of which shall
have been started within six months from the date of such approval.
