B.
Customary home occupations shall be subject to the following standards:
(1)
There shall be no more than one employee in addition to the owner/occupant.
(2)
There shall be one off-street parking space in addition to those
otherwise required by this chapter. In the event that the addition
of this parking space requires additional paving or the alteration
or addition to any structure on the site, site plan approval shall
be obtained from the appropriate board.
(3)
The area necessary for the accessory residential uses shall occupy
no more than 15% of the total floor area of the dwelling, including
basements, if occupied either in connection with the residential use
or the accessory residential use.
(4)
No storage of materials or products outside of the dwelling unit
shall be permitted, including the use of vans, trucks and other vehicles
to store materials and equipment.
(5)
The use shall be clearly incidental to the residential use of the
dwelling unit and shall not change the essential residential character
of the dwelling.
(6)
No external alterations inconsistent with the residential use of
the dwelling unit shall be permitted.
(7)
No display of products shall be visible from outside the dwelling.
(8)
Such accessory uses shall be conducted by the residential occupants,
who must be continuous occupants of the dwelling while the use is
in operation.
(9)
No advertising display shall be visible from the street or elsewhere
other than a small professional nameplate which shall not exceed two
square feet in area.
(10)
Except where specific provision is otherwise made in the Code
of the Borough of Westville, professional offices, customary home
occupations and any other business use in this district shall not
be operated from 12:00 midnight to 6:00 a.m. In applications before
the Land Use Board, the hours of operation may be further restricted
as a condition to any approval.
The Land Use Board may authorize as a conditional use the conversion
of any dwelling existing at the effective date of this chapter in
an R-1 Residential District, a C-3 Business District or an I-4 Light
Industrial District into a dwelling for not more than two families
subject to the following requirements:
A.
The lot area per family, yards and building area shall not be reduced
to less than the requirements for the district in which the lot is
situated.
B.
No structural alteration of the building exterior shall be made except
as may be necessary. Such conversion shall be limited to single-bedroom
apartments, unless such apartment shall exceed 720 square feet in
area.
C.
The Land Use Board may prescribe such further conditions with respect
to the conversion and use of such building or land as it deems appropriate
to the end that the general architectural character of the area be
maintained.
The Land Use Board may authorize as a conditional use the construction
of an apartment building to contain not more than two apartments in
an R-1 Residential District, a C-3 Business District or in an I-4
Light Industrial District subject to the following requirements:
A.
The lot area per family, yards and building area shall not be reduced
to less than the requirements for the district in which the lot is
situated.
B.
The apartments shall be limited to single-bedroom apartments unless
such apartment shall exceed 720 square feet in area.
C.
The two apartments shall abut and shall have a common wall, either
horizontal or vertical, between them.
D.
The Land Use Board may prescribe such further conditions with respect
to the construction and use of such building or land as it deems appropriate
to the end that the general architectural character of the area be
maintained.
