Owners of land wherein is located an abandoned well or a well
in use shall provide a covering for such well capable of sustaining
a weight of 300 pounds or shall fill, if an abandoned well, the same
to the level of the ground.

Owners of land which has been excavated for the purpose of making
cellar holes for buildings, and which cellar holes have been exposed
and not used for more than one year, and owners of land which has
been excavated by the removal of clay, shall erect barriers or take
other suitable measures approved by the Building Commissioner of the
City of Gardner or his designee to protect persons from damages incident
thereto.

The penalty for violation of this chapter shall be a fine of
$300 for each offense.
