The term "yard sale" as used in this chapter shall mean any sale of a yard, garage, barn or similar type nature.
A. 
No person shall conduct a yard sale without first registering with the Building Commissioner's office at least 48 hours prior to such sale.
B. 
Yard sales shall take place only between the hours of 8:00 a.m. and 4:00 p.m., shall be held not more than four days each calendar year by any one person or household and shall take place on the premises of the owner of the property to be sold or at another location designated by the Building Commissioner or his designee.

C. 
In the event that inclement weather forecloses holding such sale on a day registered, the Building Commissioner or his designee may, in his discretion, allow registration for alternate sale days.

D. 
Such registration shall be allowed only to the owner of the premises on which the sale is to be held or to an authorized tenant of said premises.
E. 
All items sold or offered for sale at a yard sale shall be owned by the person who has registered for such sale.
The person who has registered shall be required to comply with all regulations of the City ordinances in regard to any signs erected or posted with respect to the yard sale to be held.[1]

Recognized charitable, religious, and benevolent organizations shall be exempt from the provisions of this chapter.
A. 
Upon registration under this chapter, the Building Commissioner or his designee shall promptly notify the Police Department of such registration.

B. 
The Police Department shall enforce this chapter.
C. 
Any violation of this chapter shall be punishable by a fine not to exceed $20.
