Editor's Note: The provisions of this ordinance included herein were originally adopted as Ch. 32, but were redesignated as Ch. 21 to fit the organizational structure of the Code. The ordinance also authorized the Borough to execute an agreement or a memorandum of understanding with the First Aid Squad to memorialize the terms and conditions of the official reorganization referenced herein.
There is hereby established within the Borough of Eatontown an Emergency Medical Services Department.
The Emergency Medical Services Department of the Borough of Eatontown shall consist of the Eatontown First Aid Squad, otherwise known as the Eatontown Volunteer Ambulance Corp., Inc., as now constituted, or as hereinafter otherwise provided for, but additional first aid squads may be admitted, or the number of first aid squads reduced, from time to time, whenever the Borough Council shall conclude it is necessary and in the public interest, after a public hearing. Any such additions or reductions in the manner of first aid squads shall be for the welfare of the Borough, and the residents thereof.
The Officers of the Emergency Medical Services Department shall consist of a Captain, a First Lieutenant, a Second Lieutenant, and Engineer and such other officers as may be deemed necessary, or as may be provided for by the constitution and/or bylaws of the First Aid Squad, as the same may be amended from time to time.
On the second Tuesday in December of each year, or at such other time as the Emergency Medical Services Department may determine, the Emergency Medical Services Department shall elect the officials enumerated in § 21-3 herein, and such other officers as may be provided for by the constitution or its bylaws. All officials shall hold office for one calendar year, from the first day of January next ensuing, until December 31 of the same year.
Said election shall be held at a designated location within the Borough of Eatontown on the evening of the day above stated, and at the time and in such manner as the said Emergency Medical Services Department may provide. A statement of the results of any such election shall be signed by the Emergency Medical Services Department Secretary and submitted for confirmation to the Borough Council as required by § 21-16 below.
If a vacancy shall arise among the line officers, the aforesaid vacancy shall be filled by advancing existing officers and replacing the lowest office through a special election at the next regular meeting, subject to Borough Council approval.
All persons who are active members of the Emergency Medical Services Department in good standing shall have the right to vote in the officer election process, which right shall be determined by a list of the members of the respective squads, duly verified by affidavit, to be furnished by the secretary of the First Aid Squad.
A. 
Active member list.
(1) 
On or about January 1 of each calendar year, the First Aid Squad supervisors shall submit to the Borough Administrator a list of all individuals who meet the definition for active member status.
(2) 
Updates shall be provided to the Borough Administrator on a periodic basis to add those individuals who have completed their probationary status or delete individuals who have been dismissed from membership or who no longer meet the criteria for active member status.
B. 
On a form provided by the office of the Borough Administrator, each active member shall provide information related to the family status to assist the various municipal officials in their administration of this incentive program in order to be eligible for the benefit outlined.
C. 
All active members and their families must comply with all registration procedures and complete all application forms established by the Borough.
The Captain shall be in charge of, and responsible for, the care and operation of the Emergency Medical Services Department's ambulances and equipment. In the absence of the Captain, or the inability of the Captain to so serve, the next ranking officer then in charge shall be in charge and responsible for the care and operation of the Department's ambulances and equipment. The Captain shall also have general control over the members of the Emergency Medical Services Department.
The Captain may delegate to the Engineer the responsibility for the care and operation of the Department's vehicles.
In the case of an emergency service call outside of the Borough of Eatontown, the Emergency Medical Services Department vehicles shall not leave the Borough of Eatontown, unless officially dispatched.
It shall be the affirmative duty of the Captain, or designee under his/her direction, to examine, at least once a month, the Emergency Medical Services Department vehicles, and all of the equipment in use, and report such condition, in writing, to the Borough Council, on at least a quarterly basis. The Captain shall also make an annual report, in writing, to the Borough Council, at the end of each calendar year, providing a detailed account of Department activities, and such other information as the Captain may think is necessary and/or relevant.
The Captain shall use all means of the Emergency Medical Services Department to appropriately and reasonably deal with any emergencies which may occur. The Captain shall also have the sole and absolute control and command over Department vehicles and all of emergency medical incident scenes and admit only such persons, whether Department members or otherwise, to said scene, as deemed necessary so as to coordinate and direct the treatment and transportation of all injured persons. The Captain shall also have control over all other mutual aid vehicles and persons aiding and assisting with any such emergency within the Borough.
In the absence of the Captain, the command of the Emergency Medical Services Department (at an emergency scene) and all of the duties of the Captain shall devolve upon the highest ranking officer of the Department who is present at the scene. In the absence of any officer at an emergency scene, the Senior EMT on site shall assume such duties.
The Captain shall have the authority to immediately suspend any member for good cause pending a hearing as described in this section. The Borough Council may, at any time, and for good cause, suspend or remove any member or officer of the Emergency Medical Services Department, by a majority vote of all of the members of the Borough Council. However, prior to any such expulsion or suspension, the affected officer or member shall have an opportunity to be heard, publicly or privately (at the officer's/member's request), before the Borough Council. For purposes of the within chapter, "good cause" shall include, but not be limited to, the following:
A. 
Neglect of duty;
B. 
Insubordination;
C. 
Failure to perform duty;
D. 
Inability to perform duty;
E. 
Inefficiency;
F. 
Incompetency;
G. 
Chronic or excessive absenteeism or lateness;
H. 
Conduct unbecoming a public employee;
I. 
Conviction of a crime; or
J. 
Misuse of public property.
The Emergency Medical Services Department shall have the power to provide for the election of its Officers and Members, and manage its own affairs, subject to its constitution, bylaws, rules and regulations of said Department and further subject to the approval of the Borough Council, should the Borough Council see fit to exercise such right of approval. No officer and official elected by the Emergency Medical Services Department Members shall assume office until confirmation by the Borough Council.
A. 
All applicants, except Cadets, shall be a minimum of 18 years of age. Cadets shall be at least 16 years of age.
B. 
Any person desiring membership in the First Aid Squad shall complete in duplicate, filing the same with the Emergency Medical Services Department, an application, the form of which may be prescribed by the Emergency Medical Services Department but which shall contain the following information about the applicant
(1) 
Name.
(2) 
Home address.
(3) 
Birth date.
(4) 
Social security number.
(5) 
Driver's license number.
(6) 
Any conviction of a crime or a disorderly persons violation.
(7) 
Such other information as the First Aid Squad deems relevant to the application provided that none of such information is prohibited by law.
C. 
The application provided by the Emergency Medical Services Department must include a separate provision to be signed by the applicant which states that the applicant acknowledges and approves of an investigation into any criminal record the applicant may have as a prerequisite to being approved for membership in the First Aid Squad.
D. 
Processing of application. Following the filing of such application, the Emergency Medical Services Department shall transmit one of the applications to the Chief of Police of the Borough, who shall conduct an investigation to ascertain the truth of the statements made by the applicant as well as any such other investigation of the applicant's background as the Chief deems necessary for the protection of the public good. If as a result of such investigation the applicant is found to have been convicted of any crime or disorderly persons violation or any other information that would indicate the applicant may be a threat to the health, safety or welfare of the community, the Chief of Police shall report such information and particulars thereof to the First Aid Squad and to the Borough Council.
E. 
Fingerprinting of applicant. In connection with said investigation the applicant shall submit to fingerprinting, and the Chief of Police is authorized to submit the applicant's fingerprinting card and receive state criminal history record information from the Division of State Police/State Bureau of Identification for use in considering the suitability of all applicants/members covered under this chapter.

F. 
All members of the Emergency Medical Services Department shall be subject to new fingerprinting and background checks every three years from the date of adoption of this ordinance[1] or from the date of becoming a member, whichever is greater in time.

G. 
The applicant may also be required to submit to a physical performed by a licensed physician.
H. 
The above investigation by the Chief of Police shall be completed within 60 business days of receipt of the application and the fingerprinting of the applicant.
All First Aid Squad members shall be eligible for the Length of Service Awards Program (LOSAP) in accordance with Ch. 35, Art. II.

A. 
All active First Aid Squad members and their surviving spouses shall be entitled to the following benefits:
(1) 
Exemption from all recreational activity fees paid to the Borough;
(2) 
Exemptions from the municipal portion of the Uniform Construction Code fees consisting of any construction demolition, plumbing, electrical or certificate of occupancy application fees;
(3) 
Exemption from licensing fees, including but not limited to dog license, marriage license, garage sale permits, and any other licensing instituted by the Borough.
(4) 
Exemption from the zoning permit application fee.
B. 
First Aid Squad members and their surviving spouses shall pay all other municipal fees, including, by way of example:
(1) 
Any rental fees for an indoor facility.
(2) 
Fees, licenses and permits associated with any for-profit activity or associated with any property which is not the current or future residence of the active member.
(3) 
Inclusion in programs when registration is received after a maximum registration has been reached.
(4) 
Fees and escrows associated with Planning Board and Board of Adjustment site plan, subdivision and variance applications.
(5) 
Escrows associated with engineering inspections.
(6) 
Posting of performance guarantees where required.
(7) 
Borough of Eatontown Sewerage Authority charges.
(8) 
Borough of Eatontown real estate taxes.
Any person or persons who shall violate any provisions of the within chapter shall, upon conviction, be subject of a fine not exceeding $1,250, a term of imprisonment not exceeding 90 days, or a period of community service not exceeding 90 days, or any combination thereof.
