Prior to the issuance of any permit requiring demolition of any existing structure in the Town of Clinton, the applicant shall file with the Construction Official a demolition guaranty in the form of a surety bond executed by the applicant as principal and a surety company licensed to do business in the State of New Jersey as surety, a letter of credit in a form acceptable to the Municipal Attorney or a cash performance guaranty. The amount of the demolition guaranty shall be in the amount of the demolition contract or in the estimated amount of the cost of the demolition as determined by the Construction Official. The demolition guaranty shall be conditioned upon completion by the applicant of the demolition, the removal of all debris and construction materials, all necessary backfilling with clean fill, if required by the Construction Official, and the performance of any necessary repair or restoration.
Prior to the issuance of any permit requiring excavation, the applicant shall deposit with the Construction Official an excavation guaranty in the form of a surety bond executed by the applicant as principal and a surety company licensed to do business in the State of New Jersey as surety, a letter of credit in a form acceptable to the Municipal Attorney or a cash performance guaranty. The amount of the excavation guaranty shall be in the amount of the excavation contract or the estimated cost of the excavation as determined by the Construction Official. The excavation guaranty shall be conditioned upon the performance by the applicant of the following requirements:
A. 
The restoration of the roadway, its surface and paving to its original condition prior to openings for utility connections or for other purposes in connection with the construction operation. The town's Public Works/Business Administrator will determine if a road opening permit will also be required.
B. 
The restoration of any existing sidewalk or curbing to the condition that existed prior to such construction operation and repair of all damage resulting from such construction operation. The restoration will be under the direction of the town's Public Works/Business Administrator.
C. 
The refilling or backfilling of any excavation so as to restore the land to its original condition in the event of any cessation or abandonment of the construction operation which leaves the property in a dangerous or unsanitary condition or constitutes a menace to public health and safety.
All ordinances or parts of ordinances inconsistent herewith are hereby amended as to such inconsistency only.
