The Village Board of Trustees in its capacity as Water Commissioners shall establish, and may amend from time to time by resolution following a duly noticed public hearing, a schedule of water rents. The water rents will be on file with the Clerk of the Village of Brewster.
All owners and outside consumers connected to the Village of Brewster water distribution system are obligated to pay for water service.
A. 
Unpaid water rents shall be a lien on real property. The Village shall enforce its collection procedures as set forth herein.
B. 
All water rents are payable to the Village of Brewster and are to be deposited by the Clerk, to the credit of the water fund, in a bank designated by the Village Board of Trustees. By 45 days after each quarterly billing, the Village Clerk will give the Board a quarterly report which provides the quarterly totals, noting any exceptions that may have impacted collections for the quarter.
C. 
Water rents not paid by the due date shall be subject to a penalty of 10% of the amount due.
D. 
When any water bill is in arrears, the Village Board of Trustees may direct that service be terminated upon five days' prior written notice to the property owner.
E. 
The Village Clerk shall keep a written record of the date water service was discontinued and reestablished in each instance, together with a meter reading taken at the time of termination of service.
F. 
Based on an annual cycle, the Village Clerk shall transmit a written list of delinquent water arrears to the Mayor's office by the third day of the third week of May of each year.
G. 
If the water rent or charge, plus any penalties which may have accrued thereon, remains unpaid as of the close of business on the Wednesday of the third week of May of each year as shown by the statement of the Village Clerk made to the Board of Trustees, the Board shall transmit such statement to the Assessor, for the filing of the Tax Lien Delinquency List with the County Clerk, by the last day of the third week of May of each year to be included on the County and Village tax bill payable June 1 of each year as a roll section and specialized bill.
H. 
Whenever an unpaid water rent shall be included in the annual Village tax levy, as above provided, the water fund shall be credited with the amount of the unpaid rent, including penalties and when collected, the moneys, including penalties, shall be deposited to the credit of the general fund.
I. 
The penalties herein mentioned shall include any penalties on the water rents, and any penalties arising after such water rents become taxes.
The payment of water rents must include all arrears and charges to date. No partial payment will be accepted unless authorized by resolution of the Board of Trustees.
All water rents are the responsibility of the owner of the premises when such premises are leased by one or more tenants.
Water bills shall be billed on a periodic basis established at the discretion of the Village Clerk with the consideration of the best interests of the residents and approval of the Village of Brewster Board of Trustees.
A charge will be made for each time the owner requests an extra meter reading, such fee will be set forth in the fee schedule[1] and on file with the Village Clerk. An owner may request up to two additional meter readings per year. In such case, the owner shall be responsible for the cost thereof in accordance with the fee schedule.

Written notice must be given by the owner to the Superintendent and to the Village Clerk at least 10 days prior to the date desired for termination of service or that the use of water is to be discontinued. A fee, as set forth in the fee schedule,[1] shall be paid for termination of service. The owner shall be responsible for the payment of water up to the time such service is discontinued, and a written request must be filed to have the water service restored, for which service a fee shall be required as set forth in the fee schedule.

Service of any notice, authorized or directed by or on behalf of the Village Board of Trustees, may be served upon the owner personally or by posting the same in a prominent place at the premises where water is supplied, or by sending the same by mail to such party at the last address furnished to the Village Clerk. Notice shall be deemed delivered on the date it is posted on the property, personally delivered to the owner, or placed in the mail. It is the responsibility of the owner to notify the Village of any change of address within 10 days thereof.
In case of the violation of any of the rules of this chapter, the Village Board of Trustees, acting as Water Commissioners, may terminate service upon five days' notice, and service shall not be restored until the owner and the property are in full compliance with this chapter, and until all unpaid rents, fines, and penalties are paid, together with any additional fees for terminating and restoring service. Such fee schedule shall be on file in the office of the Village Clerk of the Village of Brewster.
A. 
Water rents payable by consumers outside the boundaries of the Village shall be established by the Village Board of Trustees in its capacity as Water Commissioners and may be amended from time to time by resolution following a duly noticed public hearing. The water rents will be on file with the Clerk of the Village of Brewster.
B. 
Water sold to consumers outside the boundaries of the Village shall be at such terms and upon such conditions as may be fixed by the Board of Trustees from time to time, which terms may be contained in a written contract between the Village and any such outside consumer outside the corporate limits of the Village. The Village may require a written contract to be signed prior to providing water service and to continue water service for consumers outside the limits of the Village.
C. 
Consumers to whom water is sold outside the boundaries of the Village shall be subject to disconnection of such service if any bill for water rents is not paid within 60 days after it has been rendered.
D. 
Any and all agreements to provide water service to consumers located outside the corporate limits of the Village shall be subject to the provisions of Article 11 of the Village Law of the State of New York, including but not limited to §§ 11-1116, 11-1120 and 11-1128 thereof, in addition to the provisions of § 118-a of the General Municipal Law of the State of New York.
