[HISTORY: Adopted by the Town Council of the Borough of West

It is the desire and intention of the municipal authorities
of the Borough of West View to organize an authority under the Municipality
Authorities Act of 1935, approved June 28, 1935, P.L. 463, its amendments
and supplements,[1] for the purpose of exercising any and all of the powers
conferred by said Act.

The name of the proposed Authority is the "Municipal Authority
of the Borough of West View."

The proposed Articles of Incorporation of said Authority are

ARTICLES OF INCORPORATION

TO THE SECRETARY OF THE COMMONWEALTH

In compliance with the requirements of the Municipality Authorities
Act of 1935, the Borough of West View, desiring to incorporate a municipal
authority, does hereby certify:

(a)
|
The name of the Authority is the Municipal Authority of the
Borough of West View.
|
|
(b)
|
The Authority is formed under the Municipality Authorities Act
of 1935, approved June 28, 1935, P.L. 463, as amended by the Act of
May 20, 1927, P.L. 739, and as further amended by the Act of May 17,
1939, P.L. 167.[1]

(c)
|
No other Authority organized under the acts set forth in Subsection
(b), or under the Act approved December 27, 1933 (Special Session,
1933, P.L. 114), is in existence in or for the Borough of West View.

(d)
|
The incorporating municipality is the Borough of West View,
whose municipal authorities and their addresses are as follows:[2]

(e)
|
The names, addresses and terms of office of the first members
of the Board of said Authority are:[3]

|
The term of existence of the Authority is increased for an additional
35 years past the date of the former expiration date of January 1,
2028, to the new expiration date of January 1, 2063, upon approval
of these Articles of Amendment.

The following persons, all of whom are residents of the Borough
of West View, are hereby appointed members of the Board of said Authority
with the following terms of office:[1]

The Articles of Incorporation of said Authority set forth in § 44-3 of this chapter shall be executed by the President of Council and the Mayor of the Borough of West View and attested by the Secretary of said Borough, and they are hereby authorized and directed to do all other things necessary to effect and establish the said Authority in conformity with the Municipality Authorities Act of 1935, approved June 28, 1935, P.L. 463, its amendments and supplements.[1]

The adoption of this chapter is deemed necessary for the benefit
and preservation of the public health, peace, comfort and general
welfare, and will increase the prosperity of the people of the Borough
of West View and the territory adjacent thereto.
