As used in this article, the following terms shall have the
meanings indicated:
Any sign intended to be hung either with or without frames,
possessing characters, letters, illustrations or ornamentations applied
to paper, plastic or fabric of any kind, but a single United States
national flag or the flag of the Commonwealth of Pennsylvania shall
not be considered a "banner" for the purpose of this article.
A sign which permits lights to be turned on or off intermittently
or which is operated in a way whereby light is turned on or off intermittently,
including any illuminated sign, whether or not such illumination is
kept stationary or constant in intensity and color, at all times when
such sign is in use, including any light-emitting diode (LED) or digital
information, and which varies in color or intensity. Not to be included
are time and temperature signs or those signs located in the legal
right-of-way for health and safety reasons (e.g., official traffic
signage). Intermittent messages must change in frequency greater than
one time every 15 seconds.
A sign which is not supported by attachment to a building
or a wall.
Any sign mounted to a wall or other vertical building surface
other than a wall sign.
An identification, description, illustration or device, illuminated
or nonilluminated, which is visible from any public place and draws
attention to a product, service, place, activity, person, institution,
business or solicitation or any emblem, painting, banner, pennant,
placard or temporary display designed to advertise, identify or convey
information, with the exception of national or state flags.
The area of all lettering, wording, and accompanying designs
and symbols, together with the background on which they are displayed.
Sign area excludes any supporting framework and bracing, provided
that it does not contain any lettering, wording, designs, or symbols.
Where the sign consists of a double face, only one side shall be considered
for the purpose of calculating total sign area.
Any banner sign which is stretched across and hung over a
public right-of-way.
A sign painted directly onto a building wall.

Parades and special events. In the case of a sign or banner installed
to announce a Borough-approved parade or event having received a permit
from the Borough Secretary, such signs may be installed, provided
that:

Parks and recreation areas. In the case of a sign or banner installed
to announce a Borough- or Recreation Department-approved parade or
event having received a permit from the Borough Secretary if applicable,
or the commercial sponsor of a Recreation Department- or Borough-approved
event or celebration, such signs may be installed, provided that:
(1)
Express written approval is obtained for the installation by the
Recreation Department;
(2)
The sign is maintained for no longer than 30 days, unless extended
by permission of the Recreation Department;
(4)
The sign area does not exceed 32 square feet;
(5)
The sign does not interfere with the safety of vehicular or pedestrian
traffic.
In the case of a sign, banner sign, or electronic message sign
installed to control pedestrian or vehicular traffic for a limited
duration of time, such signs may be installed without a permit, provided
that:
Any officer or employee of the Borough designated for the purpose
is hereby authorized to give notice, by personal service or by mail,
to the owner or agent, as the case may be, of any installation which
is in violation of these provisions, directing and requiring such
owner or agent to remove such sign so as to conform to the requirements
of this chapter within 48 hours after issuance of such notice. In
case any person, firm or corporation shall neglect, fail or refuse
to comply with such notice within the period of time stated therein,
the Borough shall have the authority to remove the violating sign,
and the cost thereof, together with 10% additional, may be collected
from such person, firm or corporation in the manner provided by law.
Any person, firm or corporation who or which shall violate,
fail, neglect or refuse to comply with the provisions of this chapter
shall, upon conviction thereof, be sentenced to pay a fine of not
more than $50 and costs of prosecution and, in default of payment
of such fine and costs, to imprisonment for not more than five days,
provided that each day's violation shall constitute a separate offense,
and notice to the offender shall not be necessary in order to constitute
an offense.
