This chapter is enacted for the purpose of safeguarding the best interests of the public, the homeowner, the subdivider, and the investor; encouraging well-planned subdivisions by the establishment of minimum standards for design and construction; and ensuring that new subdivisions will be integrated in the general plans for the City, thereby contributing toward an attractive, orderly, stable, and wholesome community environment with adequate municipal services and safe streets. This chapter shall not repeal, impair, or modify private covenants or public ordinances, except that it shall apply whenever it imposes stricter restrictions on land use.
For the purpose of these regulations, the following terms, phrases, words, and their derivations shall have the meaning given in this section. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
ATTORNEY and ENGINEER
The Attorney or Engineer employed by the City unless otherwise stated in the text.
BLOCK
An area of land within a subdivision that is entirely bounded by a combination or combinations of streets, exterior boundary lines of the subdivision, and streams or water bodies.
BOULEVARD
That portion of the street right-of-way between the curbline and the property line.
BUILDING LINE or BUILDING SETBACK
The line on a plat indicating the limit beyond which buildings or structures may not be erected.
CERTIFIED SURVEY MAP
A map or plan of record of a minor subdivision meeting all the requirements of § 236.34, Wis. Stats., and of this chapter.
COMMUNITY
The City of Lodi.
COMPREHENSIVE PLAN (same as "Master Plan")
A Comprehensive or Master Plan meeting the requirements of § 62.23(3), Wis. Stats., prepared by the City of Lodi indicating the general locations recommended for the various functional classes of land use, places and structures and for the general physical development of the City and includes any unit or part of such plan separately adopted and any amendment to such plan or parts thereof.
EASEMENT
A grant by an owner of land for the specific use by persons other than the owner or the public.
FINAL PLAT
A map or plan of record of a subdivision and any accompanying material as required in this chapter.
GOVERNING BODY
The Common Council of the City of Lodi.
LAND DIVISION
A division of a parcel of land into two or more lots or parcels for the purpose of transfer of ownership or building development which does not come with the definition of a subdivision under this chapter. The sale or exchange of land parcels between adjoining property owners when an additional parcel is not created and the remainder of the transferor's parcel is not reduced below the minimum lot sizes or minimum yard requirements provided by the Zoning Code or this chapter shall not be considered a land division.
LOT
A parcel or portion of land designated by metes and bounds, a registered land survey, auditors, or other means and separated from other parcels or portions by said description for the purpose of sale, lease, or separate use thereof.
LOT, BUTT
A lot at the end of a block and located between two corner lots.
LOT, CORNER
A lot at the intersection of two or more streets with two or more adjacent sides of the lot abutting a street.
LOT, THROUGH
A lot with the two opposite sides abutting two or more streets.
MINIMUM SUBDIVISION DESIGN STANDARDS
The guides, principles and specifications for the preparation of subdivision plans indicating, among other things, the minimum and maximum dimensions of the various elements set forth in the preliminary plat.
MINOR SUBDIVISION
A division of a lot or a parcel by certified survey map for the purpose of transfer of ownership or building development where the act of division creates four or fewer parcels, lots or building sites.
OWNER
Any individual, firm, association, syndicate, copartnership, corporation, trust, or any other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under these regulations.
PARCEL
Contiguous lands under the control of a subdivider(s), not separated by streets, highways or railroad rights-of-way.
PEDESTRIANWAY
The right-of-way across or within a block for use by pedestrian traffic, whether designated as a pedestrianway, crosswalk, or however otherwise designated.
PERSON
Any individual, firm, association, syndicate or partnership, corporation, trust, or any other legal entity.
PLAN COMMISSION
The Plan Commission of the City of Lodi.
PRELIMINARY PLAT
A map delineating the feature of a proposed subdivision as described herein, submitted to the Plan Commission for preliminary consideration prior to the final plat.
PROTECTIVE COVENANTS
Contracts entered into between private parties that constitute a restriction on the use of all private property within a subdivision for the benefit of the property owners and to provide mutual protection against undesirable aspects of development which would tend to impair stability of values.
STREETS and ALLEYS
A. 
STREETA public way for vehicular traffic, whether designated as a street, highway, thoroughfare, arterial, parkway, throughway, road, avenue, lane, place, or however otherwise designated.
B. 
ARTERIAL STREETA street primarily designed to carry large volumes of traffic and provide for vehicular movement between and among large areas.
C. 
COLLECTOR STREETA street which carries traffic from minor streets to arterials or from arterial to arterial. It includes the principal entrance streets of a residential development for circulation of traffic within such a development.
D. 
LOCAL STREETA street of limited continuity used primarily for access to the abutting properties and the local needs of a neighborhood.
E. 
CUL-DE-SACA street with only one outlet and having a turnaround.
F. 
SERVICE STREETA street which is parallel and adjacent to a thoroughfare and which provides access to abutting properties and protection from through traffic.
G. 
PRIVATE STREETA privately owned street serving two or more lots.
H. 
STREET WIDTHThe shortest distance between the lines delineating the right-of-way of a street.
I. 
ALLEYA minor way which is used primarily for secondary vehicular service access to the backs or the sides of properties abutting on a street.
STREET TREE
A canopy tree planted within the public street right-of-way for the purpose of providing shade and enhancing the appearance of the street.
SUBDIVIDER
Any person commencing proceedings under these regulations to effect a land division for himself or for another.
SUBDIVISION
A division of a lot or parcel of land for the purpose of transfer of ownership or of building development where:
A. 
The act of division creates five or more parcels or building sites of 1.5 acres each or less in area; or
B. 
The act of division creates five or more parcels or building sites of 1.5 acres each or less in area by successive divisions within a period of five years.
