Temporary enclosure; inspection. 

No swimming pool may be constructed until a building permit is issued by the Building Inspector, and no swimming pool may be used until a certificate of occupancy is issued by the Building Inspector.

Swimming pools shall be enclosed in accordance with the requirements of the New York State Uniform Fire Prevention and Building Code ("code").

A swimming pool, subject to the code, shall be enclosed immediately upon installation of the pool. A temporary enclosure at least four feet in height, consisting of metal stakes and turkey wire or equivalent gauge wire, may be permitted at the discretion of the Building Inspector if construction conditions so warrant. Said temporary enclosure may remain for a period of time established by the Building Inspector, which period shall not exceed three months from installation of the pool; provided, however, that the Building Inspector, after inspecting said temporary enclosure, may, in his discretion, extend the time for the temporary enclosure for an additional period not to exceed three months. The temporary enclosure shall then be replaced with the requisite permanent enclosure.
