The accumulation, collection, removal and disposal of solid waste shall be controlled by this Town for the protection of the public health, safety and welfare. It is consequently found and declared that:
A. 
This municipality is authorized by law to regulate the disposition of solid waste generated within its boundaries and to levy a fee therefor and to license refuse collectors and haulers within the jurisdiction.
B. 
This municipality has executed the municipal service agreement requiring it to cause all solid waste generated within its boundaries to be delivered to the Connecticut Solid Waste System.
The Board of Selectmen of the Town is hereby authorized to establish, enact, and enforce such regulation as it shall deem in the public interest regarding the collection, disposal and separation of recyclable materials.
The Board of Selectmen of the Town is authorized upon passage of this article to employ or contract with individuals or corporations for the collection, removal, storage or disposition of solid waste in an environmentally safe manner; and for separation and collection of all recyclable materials generated within the municipality.

All solid waste accumulated in the Town shall be collected, conveyed and disposed of by the Town or by persons or firms licensed by the Town in accordance with provisions of this article. The licensing authority for purposes of this section shall be the First Selectman or his designee.
Each refuse collector shall annually, on or before July 1st, apply for a license on such form as may be prescribed to engage in the collection of solid waste in the Town. All registrations for licenses of the collection of refuse shall be made with the First Selectman or his designee.
Any refuse collector licensed in accordance with § 250-6 of this article shall deliver all acceptable municipal solid waste generated within the Town to the Connecticut Solid Waste System in accordance with rules and regulations outlined in this article and in accordance with the municipal services agreement or agreements, as the case may be, entered into between the Town and the Connecticut Resources Recovery Authority.

Each refuse collector licensed in the Town shall deliver all solid waste meeting the contractual standards collected within the territorial limits of the Town to the Connecticut Solid Waste System Hartford Facility or such transfer station as may be designated and pay the disposal charge in accordance with the fee schedules as may be from time to time established.

All registration made by each refuse hauler for licensing in the Town shall pay a fee of $25 annually for each vehicle he operates to transfer solid waste within the Town. When a vehicle is employed to haul more than one container, each container to be transported shall be registered in accordance with the fee established for each vehicle used for the transport of acceptable solid waste.

A. 
Notwithstanding anything to the contrary within this section, the First Selectman shall have power to refuse permission to a refuse collector for a refuse permit to use the Connecticut Solid Waste System Facility when, in his opinion, such collector and/or hauler has violated this article or any other applicable rule or regulation regarding the collection, licensing and disposal of municipal solid waste within the Town.
B. 
Any person, firm, or corporation violating the terms of this article shall be fined not more than $100 for each offense in addition to any other penalty imposed hereunder.
In addition to other rules and regulations given under this article to the Selectmen of the Town, they shall be authorized under this article to establish such rules and regulations regarding the collection, storage and disposition of all materials from the waste stream which are recyclable materials, which may include such items as newspapers, other paper materials such as cardboard and computer spreadsheets and cards, glass bottles and jars, and all types of metal cans, leaves and other organic yard wastes.
