This article shall be known as the "Residential Solid Waste Refuse Ordinance of the City of Socorro, NM."
As used in this article, the following terms shall have the meanings indicated:
GARBAGE
Household wastes.
MUNICIPALITY
The municipality of Socorro, its duly authorized agents, contractors, licensees or employees.
PERSON
Any individual, firm, partnership, corporation, cooperative, association, or any other entity owning, operating, controlling or inhabiting any house or residence within the municipal corporate limits.
REFUSE
All putrescible and nonputrescible solid wastes (except body wastes), including garbage, rubbish, ashes, street cleanings, and yard clippings.
SOLID WASTE
Putrescible and nonputrescible domestic wastes, including garbage, rubbish, refuse, ashes, street refuse, and yard clippings.
A. 
Every owner, occupant, tenant or lessee using or occupying any premises within the boundaries of the municipality shall utilize the containers provided for solid waste use by the City of Socorro at such time said containers become available for distribution.
B. 
Containers shall be of the type provided by the municipality as suitable for mechanical collection by publicly owned equipment used for such collection. Containers failing to comply with these provisions or which have defects causing them to scatter waste upon the ground during collection or causing them to hamper or to injure the persons collecting waste will not be collected and shall be promptly replaced.
C. 
Disposable paper or plastic bags of a type, size and material designed for garbage disposal shall be used (as a supplemental container only) to contain garbage for storage and collection, provided they are unbroken, sealed, and filled in such manner that normal handling will not cause the bag to open.
D. 
Every owner, occupant, tenant, or lessee who is issued a City container will be responsible for:
(1) 
The cleanliness of said container.
(2) 
Moving the container to and from the curb prior to and following collection.
(3) 
Filing a police report should the container be stolen or damaged beyond repair. Any container damaged beyond repair or stolen will be replaced by the City with the proper police report. Replacement of stolen or damaged containers without a police report will be replaced at the occupant's/resident's expense. A container will be reissued by City personnel after a fee for the container has been paid by the occupant.
A. 
The owner, occupant, tenant or lessee of any premises within the municipality shall be responsible for the sanitary conditions of the premises occupied by him, and it shall be unlawful for any person to keep in or about any premises occupied by him any solid waste as herein defined unless the same is kept in authorized containers.
B. 
It is unlawful for any person to bury, dump or deposit, or to allow, permit or cause to be buried, dumped or deposited upon any street, alley or private or public property any solid waste of any kind whatsoever. All solid waste shall be transported to the municipal disposal site by the proper collection authority, or by the owner/occupant/resident of the premises.

C. 
The removal of wearing apparel, bedding or other refuse from homes or other places where highly infectious or contagious diseases have prevailed shall be performed under the supervision and direction of a health officer, and such refuse shall not be placed in containers for regular collection.

D. 
Industrial waste, dead animals, or waste from construction, remodeling, demolition, large-scale landscaping, or processing operations will not be collected, transported, or disposed of by the City's residential sanitation crew; but such waste collection, transportation, and disposal shall be by the owners and/or generators of such waste or animals.
E. 
It shall be a violation of this article to place or to cause to be placed in any container, box, or bundle, or otherwise for collection, any hazardous waste of any kind except upon specific prior arrangement with the municipality.
F. 
Ownership of solid waste material set out for collection or deposited in the municipal disposal site shall be vested in the municipality.[1]

Solid waste shall be collected from residential areas in accordance with the schedule provided by the Sanitation Department Supervisor.
A. 
There is hereby assessed against every person owning or renting a residential premises within the City limits that lies on a scheduled City of Socorro residential sanitation route a monthly fee set by Chapter 238, Article I, of the existing Code.

B. 
If any person who is obligated to pay a collection fee fails to pay or refuses to pay, the municipality may make an assessment against the real property; and if said assessment is not paid, the municipality may institute lien proceedings against said real property as provided by NMSA 1978, §§ 3-36-1 to 3-36-7, as now enacted or hereinafter amended.
C. 
Charges for solid waste collection and disposal service shall be billed and collected monthly, and shall be payable by the owner or occupant of the premises or real property at the office of the municipal treasurer.

Any person, firm or corporation violating any of the provisions of this article shall be deemed guilty of a petty misdemeanor and, upon conviction thereof, shall be punished as set forth in Chapter 1, Article III, Penalties, of the Socorro City Code.
