The provisions of this article shall be known as the "Solid
Waste Disposal Rate Schedule of the City of Socorro, New Mexico."
As used in this article, the following terms shall have the
meanings indicated:
The deposit of any solid waste or constituent thereof so
that the solid waste or constituent thereof may enter the environment.
The location or land where the final deposition of solid
waste occurs. Such facility shall meet the requirements of the New
Mexico Solid Waste Management Regulations.
All necessary activities, including replacement of equipment
or appurtenances, to assure the dependable and economic function of
a solid waste facility in accordance with its intended purpose.
Any individual City resident or private individual, trust,
firm, company, agency, corporation, partnership or association.
Putrescible and nonputrescible wastes, including garbage,
rubbish, refuse, sludge, construction waste, industrial waste and
any other waste material in a solid or semi-solid state not otherwise
defined in this article.
Any public or private system, facility, land, improvements
on the land, structures or other appurtenances or methods used for
processing, recycling or disposing of solid waste, including landfills,
transfer stations, resource recovery facilities, incinerators and
other similar facilities not specified.

Fees for disposal of approved items herein described shall be
set by resolution of the governing body.
A.
Charges for the use of the solid waste disposal facility shall be
based upon weight as follows:

(1)
For any person hauling their own yard waste in any vehicle smaller
than or equal to a standard pickup truck (two-cubic-yard capacity),
there shall be no charge for residential waste which is covered and
$3 per load for uncovered waste.
(2)
For any commercial hauler of yard waste or yard waste hauled from
a commercial establishment, the fee shall be $35 per ton covered ("fixed
fee") plus an additional $10 per load uncovered; provided, however,
the fixed fee shall increase by $1 beginning on January 1 of each
successive year from 2023 through 2027, i.e., the fixed fee for the
year 2027 shall be $40.
(3)
The fee for all construction, demolition or general waste shall be
$40 per ton covered ("fixed fee") and an additional $10 per load uncovered;
provided, however, the fixed fee shall increase by $1 beginning on
January 1 of each successive year from 2023 through 2027, i.e., the
fixed fee for the year 2027 shall be $45.

Tires shall be accepted at the landfill at the rate of $1 per passenger
tire and $1.50 for any tire larger than a passenger tire; provided,
however, tires in excess of eighteen-inch rim diameter will not be
accepted.
(5)
The fee for disposal of dead animals at the landfill shall be between
$5 and $100, depending on the size of the animal.
B.
The fees imposed by this section shall be paid by the person disposing
of the solid waste at the disposal site prior to disposal or the person
shall have an account set up at City Hall prior to disposal. The landfill
gate attendant shall make, in duplicate, a record of each time a vehicle
discharges solid waste at the disposal site. Such record shall show
the date, the time of day, the vehicle owner's name, the vehicle license
plate number, its gross tare and net weights, associated tonnage,
and the fee assessed and collected. The record shall be signed by
the driver of the vehicle and by the gate attendant. One copy of the
record shall be given to the driver and the original shall be retained
by the gate attendant and filed daily with the municipal billing clerk.
A.
For purposes of conducting any study, taking any corrective action
or enforcing the provisions of the State of New Mexico Solid Waste
Management Regulations, any person who transports or disposes of solid
waste shall furnish information relating to such solid wastes and
allow the City's authorized representative to inspect and obtain samples
of any solid wastes arriving at the site for disposal.
B.
Upon request, any person shall provide to the City's authorized representative
a manifest containing the following information:
(1)
Name and address of the solid waste hauler.
(2)
Name and address of the producer (source of waste).
(3)
The type and quantity of the waste.
(4)
A statement indicating that the solid waste does not contain any
"special waste" requiring special handling as per the State of New
Mexico Solid Waste Management Regulations.
(5)
The producer's signature acknowledging that the information above
is correct.
C.
Upon inspection, the City's authorized representative may deny disposal
of waste(s) unacceptable for disposal at the City's facility. Upon
request, the person shall remove such waste(s) from the disposal site.
All disposal of solid waste shall be at the disposal sites operated
in accordance with state laws and with rules and regulations of the
New Mexico Environment Department and at no other place. Solid waste
deposited during operating hours at any site operated by the municipality
shall be placed at areas designated by the attendant on duty. A dead
animal, large appliances, stumps, or logs over four feet in length
shall not be deposited at publicly operated sites except by prior
arrangement with the municipality. Motor vehicle bodies or major parts
thereof, liquids or any hazardous wastes are not acceptable for disposal
at the municipal landfill. Fees for disposal of approved items herein
described shall be set by resolution of the governing body.
No person shall haul or cause to be hauled on or along any public street or alley in the City any garbage or refuse unless such material shall be contained in vehicles or receptacles so constructed as to prevent the contents from falling, leaking, blowing or spilling therefrom, any odor escaping therefrom and so as to prevent any flies, insects or rodents from having access to the contents thereof. All refuse shall be properly covered to avoid spilling along the route to the disposal site. Violators will be given a first-time warning (and charged appropriately) and charged with a violation for any reoccurrence in accordance with § 200-22 of this article and in accordance with the City of Socorro's Waste Control Ordinance.[1]
