A. 
The Village Board of Trustees of the Village of Lancaster hereby finds and declares that graffiti poses a serious problem for our residents and merchants. The unabated proliferation of graffiti is a physical blight upon the landscape of our Village and costs taxpayers, merchants and homeowners substantial moneys to remove and repair. The Village Board also finds that, when unchecked, graffiti presents an image of a deteriorating community that no longer cares about itself.
B. 
The Village Board is mindful that the making of graffiti is a crime pursuant to the provisions of § 145.60 of the Penal Law of the State of New York. Accordingly, sanctions for the making of graffiti shall not be set forth herein. However, for purposes of and in the service of graffiti abatement, the Village Board by this chapter hereby defines "graffiti" and furthermore shall define "nuisance" as set forth in Chapter 221 of this Code to include graffiti, as defined herein. Through these enactments, the abatement of graffiti shall be obtained through the procedures and sanctions set forth within Chapter 221 of this Code.
As used in this chapter, the following terms shall have the meanings indicated:
BUILDING
Any structure used for commercial, institutional, governmental, business or residential purposes, and any structure appurtenant to said use, such as garages, fences, retaining walls, facades or any other structure located in the Village of Lancaster.
GRAFFITI
Any mark, figure, drawing, inscription or other notation drawn, written, etched, painted or otherwise placed on any surface, building or property, including the use of stickers or paste-on stamps containing the marks defined herein, with the intent to damage such building or property without the prior permission of the owner or occupant thereof.
PROPERTY
Any real property and appurtenances and personal property, including all trailers, vehicles or other similar personal property, wherever it may be.
