GENERAL REFERENCES
Peace and good order — See Ch. 327.
As used in this chapter, the following terms shall have the
meanings indicated:
Includes any instrument, board, machine, article or other
device used and operated for the playing of games of skill, miniature
games of hockey, bowling, baseball, basketball and shuffleboard, or
similar games in which the element of chance is not involved and for
which a consideration either in coin or other thing of value is required
for the playing thereof, whether or not a coin slot is affixed to
the device, but shall not be deemed to include any gambling device.
Any instrument, device or thing used or usable for gambling
or playing any game of chance for money or any other thing of value.
Any person, firm, or corporation owning and operating one
or more amusement devices set up for use in the City.
Any instrument or device which is operated by the insertion
of any coin or token and which may entitle the operator to any money,
tokens, merchandise or other thing of value as a prize or reward for
any result of such operation over which the operator has no control.
It shall be immaterial that any such instrument or device may also
vend merchandise.

Any person owning or providing any amusement device, or maintaining
such amusement device on premises owned or under the control of any
such person, shall register such amusement device as herein required.
Every amusement device shall be registered with the City Clerk/Treasurer
by the owner or possessor thereof. The registration fee as provided
in the City's Fee Schedule shall be required for each amusement device.
Such registration fee shall be paid to the City Clerk/Treasurer at
the time of registration. The City Clerk/Treasurer shall require the
registrant to submit such information as may be necessary to identify
the amusement device so registered. Each amusement device shall be
registered on each successive first day of July. Nothing herein contained
shall be construed to authorize the registration of any slot machine
or gambling device.

The Mayor, Chief of Police or any police officer of this City may
seize or cause to be seized any amusement device which is not registered
as herein required.
B.Â
"Possessor" as herein used shall mean the physical presence of a
prohibited device in any premises under the management or control
of the person charged as possessor.
Except as otherwise specifically provided in this chapter, any person found to be in violation of any provision of this chapter shall be subject to a penalty as provided in § 1-4 of this Municipal Code. Such penalty may be in addition to the revocation, suspension or nonrenewal of any license or permit issued under the provisions of this chapter.
