[HISTORY: Adopted by the Common Council of the City of Markesan
as Ch. 1, Secs. 1.01 through 1.07, of the 1991 Municipal Code. Amendments
noted where applicable.]
The City of Markesan operates under the Mayor-Common Council
system of government.
A.
Mayor. The Mayor shall be elected in odd-numbered years for a term
of two years.
B.
Alderpersons. The Common Council shall consist of six Alderpersons
elected for two-year terms. One Alderperson shall be elected annually
from each of the three aldermanic districts.[1]

for the consolidation of the office of City Clerk and City Treasurer
and made this office appointive by the Mayor, subject to confirmation
of the Common Council, rather than by election. This ordinance also
combined the office of Purchasing Agent with the office of the City
Clerk-Treasurer.

Editor's Note: Charter Ord. No. 96, adopted 12-3-1968, stated
that the Attorney of the City of Markesan shall be appointed by the
Mayor, subject to confirmation by a majority vote of the members-elect
of the Common Council, for a term of one year; the City elected not
to be governed by provisions of § 62.09(3)(b) and (5)(b),
Wis. Stats.
A.
Salaries and fringe benefits. The salaries and fringe benefits of
City officers and employees shall, from time to time, be established
by the Common Council in accordance with state law and the City Personnel
Policy.

The Mayor shall be paid at a rate per meeting attended as follows:

If the Mayor chairs any of the above meetings, except Council,
he shall receive $60 for each said meeting.

Members of the Common Council are to be compensated for meetings
at the following rates:

(b)
Any Alderperson who chairs a committee meeting shall receive
$60 per meeting.
(3)
Meals and lodging. Reimbursement for meals consumed outside of the
City by the Mayor and Common Council members while on official City
business shall be at the actual amount expended, with receipts being
required. Further, reimbursements for lodging shall be at the actual
cost per night, with receipts being required. Automobile mileage shall
be reimbursed at the rate established by the Federal Internal Revenue
Service (IRS) as allowable for full deduction on income tax returns
for all miles driven on City business on or after March 1, 1994, with
all adjustments to said rate being made in accordance with subsequent
IRS adjustments.
B.
Powers and duties of City officials. City officials mandated under
§ 62.09, Wis. Stats., shall have the powers and duties prescribed
by law and, except for the Mayor, shall perform such duties as shall
be required of them by the Common Council. Other City officials shall
perform the duties prescribed by the Common Council.
C.
Multi-offices. The Common Council may elect to appoint the same person
to two or more compatible offices.
D.
Removal from office. All City officials, except the Police Chief,
may be removed from office for cause by a 3/4 majority vote of the
members-elect of the Common Council.
E.
Residency requirements. City employees are not required to be bona
fide residents of the City. However, all police officers, while on
call as police officers for the City, must be readily available and
shall be within the City limits or within a three mile radius of the
City limits, measured by road distance, at all times while on call
as police officers for the City.[1]

A.
No employee or official of the City shall receive or offer to receive,
either directly or indirectly, any gift, gratuity or anything of value
in excess of $15 which he is not authorized to receive from any person
if such person:
(1)
Has or is seeking to obtain contractual or other business or financial
relationship with the City or the Common Council;
(2)
Conducts operations or activities which are regulated by the City
or the Common Council; or
(3)
Has interests which may be substantially affected by the City or
the Common Council.
B.
The receipt of any gift, gratuity or anything of value, as denoted
above, is contrary to the public policy of the City.
A.
Any member of the Common Council who has a financial interest or
personal interest in any proposed legislation before the Common Council
shall disclose on the records of the Common Council the nature and
extent of such interest.
B.
Any other City official or employee who has a financial or personal
interest in any proposed legislative action of the Common Council
and who participates in discussion with or gives an official opinion
or recommendation to the Common Council shall disclose on the records
of the Common Council the nature and extent of such interest.
A.
Clerk-Treasurer. The Clerk-Treasurer shall perform the duties prescribed
by law for City clerks, treasurers and comptrollers, and such other
duties required by the Common Council. The ClerkTreasurer shall
also serve as City Purchasing Agent. The City of Markesan elects not
to give the bond on the City Treasurer provided for by § 70.67(1)
of the Wisconsin Statutes. Pursuant to § 70.67(2) of the
Wisconsin Statutes the City shall be obligated to pay, in case the
Treasurer fails to do so, all state and county taxes required by law
to be paid by the City Treasurer to the County Treasurer.

B.
City Attorney. The City Attorney shall be duly admitted to practice
in the courts of record in the State of Wisconsin, shall conduct all
the legal business in which the City is interested, and shall perform
all duties required by City attorneys by State law.
D.
City Assessor. The City Assessor shall be certified by the Wisconsin
Department of Revenue at the level required by law and shall be experienced
and capable of performing the duties of the office.
E.
Director of Public Works. The Director of Public Works shall have
powers and duties, as follows:
(1)
The Director shall be subject to the direction of the Common Council
and the Mayor, shall be responsible for the administration and supervision
of all maintenance, repair and construction of streets, alleys, curbs
and gutters, sidewalks, bridges, street signs, lights and light systems,
traffic control devices, storm sewers, culverts and drainage facilities,
and all machinery, equipment and property used in any activity under
the Director's control. He shall be available in an advisory and supervisory
capacity to all departments of the City upon request.
(2)
The Director shall have charge of such public services as the annual
refuse collection and disposal, snow and ice removal, street cleaning
and flushing and such other activities as may be assigned to him,
from time to time, by the Common Council.
F.
Other officers. Other officers shall respectively perform such duties
as are prescribed by the Common Council.
