The purpose of this chapter is to enact a comprehensive revision of the traffic regulations of the Township of Readington so as to organize and establish them under one heading to be known as "Chapter 225, Vehicles and Traffic."
Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.
A. 
Traffic control signals.
(1) 
Traffic control signals shall be installed and operated at the intersection of those streets described in Schedule I, attached to and made a part of this chapter.[1]

(2) 
The traffic signal installation shall be in accordance with the provisions of An Act Concerning Motor Vehicles and Traffic Regulations, Subtitle 1 of Title 39 of the New Jersey Statutes Annotated, and shall conform to the design and shall be maintained in operation as authorized by the Department of Transportation of the State of New Jersey.
B. 
Speed limits.
(1) 
The speed limit for both directions of traffic along the streets or parts thereof described in Schedule II, attached to and made a part of this chapter, is hereby established at the rate of speed indicated.[2]

(2) 
Regulatory and warning signs shall be erected and maintained to effectuate the above-designated speed limits.
C. 
One-way streets. The streets or parts of streets described in Schedule III, attached to and made a part of this chapter, are hereby designated as one-way streets in the direction indicated.[3]

D. 
U-turns. No person shall make a U-turn on any of the streets or parts of streets described in Schedule IV, attached to and made a part of this chapter.[4]

E. 
Prohibited turns at intersections. No person shall make a turn of the kind designated (left, right, all) at any of the locations described in Schedule V, attached to and made a part of this chapter.[5]

Commercial motor vehicles over certain weights excluded.[11]

(1) 
Commercial motor vehicles having a total combined gross vehicle weight (plus load) in excess of the gross weights indicated are hereby excluded from the streets or parts of streets described in Schedule XI, attached to and made a part of this chapter, except for the pickup and delivery of materials on such streets or parts thereof.
(2) 
Such weight limit restrictions do not apply to state, county or local government licensed vehicles, omnibuses, school buses and/or van pools, farm vehicles, farm equipment or liveries.

A. 
Regulations not exclusive. The provisions of this section imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute, or as hereinafter provided.
B. 
Parking prohibited at all times. No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XII, attached to and made a part of this chapter.[1]

C. 
No stopping or standing. No person shall stop or stand a vehicle upon any of the streets or parts thereof described in Schedule XIII, attached to and made a part of this chapter.[2]

D. 
Parking prohibited certain hours. No person shall park a vehicle between the hours specified in Schedule XIV, on any day, unless otherwise indicated, upon any of the streets, or parts of streets, or within certain municipally owned parking lots described in said Schedule XIV, attached to and made a part of this chapter.[3]

E. 
Time limit parking. No person shall park a vehicle for longer than the time limit shown in Schedule XV at any time between the hours listed in said Schedule XV, on any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XV, attached to and made a part of this chapter.[4]

Angle parking. No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XVI, attached to and made a part of this chapter, except at the angle designated and only within the painted white stall lines.[5]

I. 
Truck parking.
(1) 
No person shall park any truck or other vehicle having a total combined gross weight of vehicle plus load in excess of six tons, or permit the same to be parked, upon any public street or highway in this Township, between the hours of 9:00 p.m. and 6:00 a.m. on any day.
(2) 
This Subsection I shall not apply to a truck or other vehicle being used in the process of construction or reconstruction of a street or highway, which construction or reconstruction is being undertaken contemporaneously with the parking of such truck or other vehicle at the same place as, or at an adjacent place to, such parking.
A. 
Parking prohibited during state of emergency.
(1) 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle that has been parked prior to the posting of the signs.
(2) 
The effectiveness of this section is contingent upon the signs being erected as required by law.
B. 
Posting of signs.
(1) 
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where temporary emergency no-parking signs are displayed. The Chief of Police or, in his/her absence, the ranking police officer is authorized to declare an emergency and to direct the posting of said emergency no-parking signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
(2) 
Notification that the emergency no-parking signs are being or will be posted shall be given to the operator or owner of any vehicle that has been parked prior to the posting of the signs.
C. 
Removal of vehicles. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal before regaining possession of the vehicle.
D. 
Effectiveness of section. The effectiveness of this section is contingent upon signs being erected as required by law.
E. 
Enforceability. In order to enforce this § 225-5 during a declared state of emergency, proper signage must be in place as required by law.
A. 
Hunter's Crossing condominium development. The provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots at the Hunter's Crossing development located in the Township of Readington, County of Hunterdon, and the following regulations shall be enforceable:
(1) 
Parking. No person shall park a vehicle on any roadway in the Hunter's Crossing condominium development. For the purposes of this section, "roadway" means the following roads: Foxchase Drive, Foxchase Drive West and Fawn Drive.
(2) 
Handicapped parking.
(a) 
All stalls for handicapped parking shall be 12 feet wide and shall contain R7-8-type signs, which include a "Reserved Parking" sign and penalty plate, in the designated parking areas. Such parking shall be reserved for persons who have been issued handicapped parking permits by the Division of Motor Vehicles.
(b) 
In the Clubhouse parking lot, the first two stalls in the easterly end of the parking lot, south side, shall be designated as handicapped parking in accordance with Subsection A(2)(a) above.
(3) 
Through streets.
(a) 
The following streets or parts of streets are hereby designated as through streets: Foxchase Drive, from Route 202 to its terminus at Fawn Drive.
(b) 
Stop signs shall be installed on the near right side of each street intersecting the through streets as follows:

(4) 
Stop intersection.
(a) 
The following street or parts of the street are hereby designated as a stop intersection: Foxchase Drive West and Sparrow Court.
(b) 
Stop signs shall be installed on the near right side of each street as follows: on Sparrow Court, where it intersects Foxchase Drive, where it intersects Fawn Drive.
(5) 
Speed limits.
(a) 
The speed limit for both directions of travel on all roadways, as defined in Subsection A(1) of this section, in the development shall be 25 miles per hour for the entire length of each road.
(b) 
Regulatory and warning signs shall be erected and maintained to effect the above-designated speed limits authorized by the Department of Transportation.
(6) 
Towing. Any vehicle parked or standing so as to obstruct or impede the normal flow of traffic or block entrances, exitways or pedestrian walkways, or which presents in any way a safety or traffic hazard, may be towed at the owner's or operator's expense.
(7) 
Installations. All signs, posts or other necessary materials shall be installed and paid for by Hunter's Crossing. Work shall be checked by the Police Department of the Township to ensure that the installations meet state and federal specifications, and all signage shall conform to the current Manual on Uniform Traffic Control Devices.
B. 
Whitehouse Village condominium development. The provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots at the Whitehouse Village condominium development located in the Township of Readington, County of Hunterdon, and the following regulations shall be enforceable:
(1) 
Parking. No person shall park a vehicle on any roadway in the Whitehouse Village condominium development. For the purposes of this section, "roadway" means the following road: Wildflower Way.
(2) 
Handicapped parking.
(a) 
All stalls for handicapped parking shall be 12 feet wide and shall contain R7-8-type signs, which include a "Reserved Parking" sign and penalty plate, in the designated parking areas. Such parking shall be reserved for persons who have been issued handicapped parking permits by the Division of Motor Vehicles.
(b) 
In the clubhouse parking lot, the east side, second stall and north end, shall be designated as handicapped parking in accordance with Subsection B(2)(a) above.
(3) 
Through streets and stop intersections. The following streets or parts of streets are hereby designated as stop intersections. Stop signs shall be installed on the near right side of each street from Juniper Drive to the most northerly drive to Juniper Drive and the most southerly drive.
(4) 
Speed limits.
(a) 
The speed limit for both directions of travel on all roadways in the development shall be 25 miles per hour for the entire length of each road. For the purpose of this section, "roadway" means Wildflower Way.
(b) 
Regulatory and warning signs shall be erected and maintained to effect the above-designated speed limits authorized by the Department of Transportation.
(5) 
Towing. Any vehicle parked or standing so as to obstruct or impede the normal flow of traffic or block entrances, exitways or pedestrian walkways, or which presents in any way a safety or traffic hazard, may be towed at the owner's or operator's expense.
(6) 
Installations. All signs, posts or other necessary materials shall be installed and paid for by Whitehouse Village. Work shall be checked by the Police Department of the Township to ensure that the installations meet state and federal specifications, and all signage shall conform to the current Manual on Uniform Traffic Control Devices.
C. 
Wa-Wa Food Market. The provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots at the Wa-Wa Food Market (Route U.S. 202 and Summer Road) located in the Township of Readington, County of Hunterdon, and the following regulations shall be enforceable:
(1) 
References to roads. For the purposes of this section, Roads A, B, C and D refer to the roadways so marked on the attached as-built map, which is made a part hereof.[1]

(11) 
No trucks or other vehicles of any kind in excess of 15,000 pounds' registered vehicle gross weight shall be permitted to enter the premises at any time, except delivery trucks which are in the process of making deliveries to the WaWa property.
D. 
Winfield Management development. The provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots within Block 8, Lot 3 (742 Route U.S. 22 and Haver Place), located in the Township of Readington, County of Hunterdon, and the following regulations shall be enforceable:
(1) 
References to roads. For the purposes of this section, Roads A, B, and C refer to the roadways so marked on the attached as-built map, which is made a part hereof.[3]

E. 
Retail development (Hartman Project, Block 36, Lot 48). The provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots within Block 36, Lot 48 (Route U.S. 22 and Coddington Road), located in the Township of Readington, County of Hunterdon, and the following regulations shall be enforceable:
(1) 
References to roads. For the purposes of this section, Roads A, B, C and D refer to the roadways so marked on the attached as-built map, which is made a part hereof.[5]

Unless another penalty is expressly provided by New Jersey statute, any person who violates the provisions of this chapter shall, upon conviction, be subject to a fine of not less than $50 nor more than $250 (plus court costs, if contested) and/or a period of community service not exceeding 15 days, or both. Each day a violation continues after the time required for the abatement thereof shall constitute a separate offense.
If any section, paragraph, subsection, clause or provision of this chapter shall be adjudged by the courts to be invalid, such adjudication shall apply only to the section, paragraph, subsection, clause or provision so adjudged and the remainder of this chapter shall be deemed valid and effective.
All former traffic ordinances of the Township of Readington and all ordinances or sections or portions of ordinances or the Readington Township Code which are in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
This chapter shall become effective immediately upon publication according to law.
