The purpose of this article is to provide for the use of portable and chemical toilets. This article is to impose conditions in which such units may or may not be used in conjunction with other permitted uses in the Township.
Pursuant to the Pennsylvania Sewage Facilities Act,[1] Coolbaugh Township may adopt an ordinance for more effective enforcement of the Pennsylvania Sewage Facilities Act and require the following standards for the permitting and intended use of portable or chemical toilets within the Township.

A. 
As used in this article, the following terms shall have the meanings indicated:
BOARD
The Board of Supervisors of Coolbaugh Township, Monroe County, Pennsylvania.
CHEMICAL TOILET
Receptacle used to accept sewage for disposal at another site. These units utilize a chemical solution to eliminate odors.
ON-LOT DISPOSAL SYSTEM
A subsurface sewage treatment system designed to dispose of sewage on the property of use and consistent with the official sewage plan of Coolbaugh Township.
PERMITTED USE
Any use of property in Coolbaugh Township for which a permit is issued by the Township Zoning Officer.
PRIVY
A tank designed to receive sewage where water under pressure is not available.
RETAINING TANK
Any receptacle used to accept sewage for ultimate disposal at another site.
SEO
Sewage Enforcement officer of Coolbaugh Township, responsible for enforcement of the Pennsylvania Sewage Facilities Act.[1]

B. 
Any definition not specifically defined in this section shall have the same definition as found in the Pennsylvania Sewage Facilities Act.
A. 
Restrictions and conditions. Any permanent use of property within Coolbaugh Township will require the installation of the appropriate on-lot sewage disposal system. Chemical toilets will not be permitted on any site when the sole purpose of the unit is to circumvent the installation of an appropriate on-lot disposal system.
B. 
Use of portable toilets. The use of portable toilets will be permitted for the following activities:
(1) 
Seasonal activities. The use of chemical toilets will be permitted at the various athletic fields throughout the Township for the summer baseball season and only upon the receipt of a proper application fee.
(2) 
Construction sites. The use of portable toilets at construction sites within the Township will be permitted for the period of construction and upon receipt of the proper application and fee. The application and permit must be renewed and the fee paid every six months for the duration of the project.
(3) 
One day or special events. The use of chemical toilets may, at the discretion of the Township, be permitted for special activities, i.e. craft shows, concerts, Township-sponsored events, special activities or private parties to ease the burden on existing on-lot systems.
A. 
Application to be made on the forms provided by Coolbaugh Township.
B. 
Applicable fees must accompany the application.
C. 
The application must include the following information:
(1) 
Duration of use.
(2) 
Tax Map parcel number of the property identification number (PIN).
(3) 
Type of use or event for which permit is requested.
(4) 
Name and address of owners of the unit and person responsible for maintaining unit.
(5) 
Property owner's name and address.
This article will cover all chemical toilets within Coolbaugh Township and will require the removal of all units not in compliance with this article by December 31, 1997. There is no "grandfather" clause provided for by this article.
Any person, organization or corporation not complying with the terms of this article will be subject to the same fines and penalties as provided in the Pennsylvania Sewage Facilities Act. (Act 537).
