All purchases of equipment, supplies and contractual services and all sales of personal property which have become obsolete or surplus, any of which individually have estimated values of less than ten thousand dollars ($10,000.00), shall be made in the open market, with or without newspaper advertisement, with the consent and approval of the City Manager.

In the event only one (1) vendor source is available, either due to the nature or brand name of the specific item(s) or service(s) to be purchased, said purchase shall not require more than a single bid, provided any such purchase is considered vital to continued service delivery. In all other cases, open market purchases shall be based on at least three (3) competitive bids. Purchases shall be awarded to the lowest and best bidder and sales of personal property shall be made to the highest bidder based on competitive bidding.

A. 
The City Manager may direct the head of the using agency or the agent to solicit bids by:
1. 
Direct mail requests to prospective vendors or buyers, or
2. 
Telephone quotes from prospective vendors or buyers, or
3. 
Electronic mail or facsimile quotes from prospective vendors or buyers, or
4. 
Public notice posted on the bulletin board of City Hall.
B. 
Whenever the direct mail or telephone solicitation options of this Section are authorized, the City's vendor file applicable to either the purchase or prospective sale shall be utilized. Reasonable efforts shall be made to solicit bids from and give preference to local vendors.

The agent shall keep a record of all open market purchases or sales of personal property submitted in competition thereon and all such records shall be open to public inspection. A monthly report shall be made to the City Council of purchases made under this Section, not previously approved, of major operational expenses of capital items.
