[R.O. 2009 §8.15.010]
As used in this Article, the following terms shall have these prescribed meanings:
APPROVED SMOKE ALARM AND FIRE DETECTION EQUIPMENT
Equipment which has been manufactured and installed and which must be maintained in compliance with the Uniform Fire Code, 1984 Edition, as amended, the Uniform Building Code as from time to time amended and adopted by the City Council and which is listed in the Underwriters Laboratory listings of such equipment.
HOUSING UNITS
Any structure designed for or actually used, whether on a temporary or permanent basis, for domestic living functions including sleeping, specifically including, without limitation, private owned occupied houses, rental houses occupied by third (3rd) persons, apartment houses, duplexes, multi-family housing units, hotels, motels, hospitals, clinics, rooming houses, dormitories, barracks, mobile homes or manufactured homes.

No housing unit shall be used or occupied as such, following January 1, 1994, which has not been equipped with approved smoke alarms/fire detection equipment as hereinafter provided.

Following the passage of this Article no occupancy permit for any building, remodeling or conversion of housing units shall be issued until the structure for which the permit is sought has been equipped as herein directed.

Location Of Detectors In Homes. Each residential unit shall have a minimum of one (1) smoke detector per level and detectors shall be located so as to protect each sleeping area in the home. When sleeping rooms are located on the upper level of a residence, a detector shall be located near the center of the ceiling directly above the stairway serving the upper level. Additional detectors may be required on an upper level where sleeping rooms are removed from the stairway. Those properties with a basement shall have a detector installed as near the stairway as possible.

A. 
Duties Of Both Owners And Tenants. It shall be the duty of the owner to supply and install all required detectors. The owner shall insure that the detector is operating properly upon installation and upon each change of tenant. The owner shall be responsible for installing, testing and maintaining detectors in common stairwells.
B. 
It shall be the responsibility of the tenant to provide and replace the batteries as needed and to test and maintain detectors within their respective dwelling units. It shall also be the duty of the tenant to notify the owner or authorized agent of any deficiencies or malfunctions.

Upon receipt of notification of deficiencies, the owner or authorized agent shall take immediate steps to correct the problem by either repairing or replacing the defective unit. Replacement detectors shall be provided in the event that repairs will be delayed. It shall likewise be the duty of the owner to provide the tenant with written information regarding detector testing maintenance.
