It is hereby declared that the purpose of this article is to
provide regulations for the parking of chartered auto buses within
the Town of Bethany Beach.
As used in this article, the following terms shall have the
meanings indicated:
Includes all motorbuses and autobuses transporting passengers for hire, except that the regularly scheduled buses of a public-funded public transportation utility, the Town of Bethany Beach trolley or permitted shuttles as designated by Chapter 227, Vehicles and Traffic, Article IX, Shuttle Buses, of the Bethany Beach Town Code shall not be included within such definition. Such regularly scheduled buses of such public transportation utilities as listed in this definition are hereby exempt from this article.
Any thoroughfare, avenue, boulevard, lane, alley or other
public way within the corporate limits of the Town.
A.
Any person desiring to park in a bus in Bethany Beach shall first
obtain a permit from the Town Manager of the Town for each individual
bus being parked. The application shall be made in writing at least
10 days prior to the permit date desired. It shall be accompanied
by the required parking fee for each bus, for each day for which the
parking reservation is required. Upon receipt of the parking fee,
the Town Manager shall determine the availability of the requested
spaces for the dates for which an application is made. If space is
available, the Town Manager shall mail or cause to be mailed or delivered
electronically to the applicant a parking permit or permits for the
spaces requested. All buses transporting persons for hire to the Town
shall have such permits prominently displayed on the right side of
the windshield at all times while within the corporate limits of the
Town.

The number of permits issued shall be determined by the number of
available spaces.
C.
The fee for parking a bus shall be $100 per day during the period
from April 1 to September 30 and $50 per day all other times.
A.
The discharge and loading of such buses shall only occur at the Town's
shuttle and motor bus passenger pickup and discharge area located
on North Garfield Parkway west of Pennsylvania Avenue, except the
Town Manager may, for good cause shown, from time to time, and in
specific cases only, upon prior notice, allow loading and discharge
of passengers at some other location.
B.
Buses to be attended or locked. Buses parked or standing in the area
designated in this article must be, if unattended, locked, and in
no instance shall the operators of said buses allow the motors to
be running when the bus is not moving or preparing to move.
The operator of the bus shall be responsible for compliance
with the requirements of this article concerning parking, loading
and discharging of passengers.
Nothing contained in this article shall be construed as prohibiting
buses transporting participants in a Town-authorized parade, Town-authorized
special event or Town-authorized entertainment to load or discharge
said participants in designated areas, provided an appropriate permit
has been issued.
