The provisions of this Chapter shall be held to be the minimum requirements adopted for the promotion and preservation of public health, safety and general welfare and to improve, protect and preserve the environment of the City and its surrounding area. This Chapter is not intended to repeal, abrogate, annul or in any manner interfere with existing regulations or laws of the City, nor conflict with any laws of the State, except that unless otherwise noted in this Chapter, this Chapter shall prevail in cases where it imposes a greater restriction than is provided by existing laws or regulations.

Any requirement or provisions of this Chapter may be changed and amended from time to time by the City Council; provided however, that such changes or amendments shall not become effective until after study and report by the City Planning and Zoning Commission.

Whenever the strict enforcement of this Title would entail unusual difficulties or hardships due to exceptional topographic or other physical conditions, the City Planning and Zoning Commission and the City Council may vary or modify them in such a way that the subdivider be allowed to plan and develop his/her property and record a plat of same; provided however, that the public welfare and interest of the municipality is fully protected and the general intent and spirit of the regulations preserved.

To obtain approval of a proposed subdivision by the Planning and Zoning Commission and City Council, the subdivider shall prepare and submit a sketch plan to the Zoning Officer and preliminary and final plats to the Planning and Zoning Commission of the tract or parcel of land proposed to be subdivided.

A public hearing shall be held by the Planning and Zoning Commission and City Council before adoption of an ordinance approving a subdivision. Notice of such hearings shall be given by publication in some legal newspaper of general circulation stating the time and place of such hearing which shall not be earlier than fifteen (15) days from the date of such public hearing; further, the property owners abutting the property proposed to be subdivided shall be mailed a notice of the public hearing by regular mail service.
