The City having acquired the title to the cemetery formerly
known as the Odd Fellows Cemetery, the name of the cemetery is changed
to the City Cemetery of the City of Union. The City has also acquired
the title to the cemetery formerly known as the Chiles Cemetery, which
is now also a City cemetery.

All monies collected from the sale of graves or lots in the
City cemetery shall be paid to the City Clerk to be credited fifty
percent (50%) to the General Revenue Fund and fifty percent (50%)
to the Perpetual Care Cemetery Fund.

The Sexton shall not make any deed for a grave or lot in the
City cemetery, or any part thereof, until the purchase price for the
grave or lot has been paid to the City Clerk.

Any person trespassing on the grounds of the City cemetery by
digging a grave or by burying a body therein without such grave being
first (1st) located by the sexton, or otherwise violating any of the
provisions of this Chapter, shall be deemed guilty of an ordinance
violation.

A.
The
following rules shall govern the operation and maintenance of the
Union City Cemetery:
1.
Cement or stone curbings, fences, rails or anything that would interfere
with mowing will not be permitted.
2.
All grave stones or grave markers shall be placed within the boundaries
of the grave space(s) and shall extend no closer than six (6) inches
to the side line of the respective space(s).
3.
No monument shall be allowed on adjacent spaces or into the alleys
or passage lines.
4.
No trees, shrubbery or other growth except grass is to be planted
on any grave(s) or lot(s). The City shall have the authority to remove
any and all such obstructions as may appear.
5.
It is the intent of the City government that the cemetery will be
kept mowed and clean, and anything that interferes will not be permitted.
6.
Memorial and/or floral pieces must be placed next to the grave markers
so as not to interfere with maintenance of the cemetery. All items
will be removed by maintenance crews as they deem necessary for proper
cemetery appearance.

Concrete vaults shall be required for all interments.
9.
Mixed, set concrete foundations shall be required as a base for all
headstones and shall be a minimum of twenty-four (24) inches deep.
10.
Care and placement of headstones shall be the responsibility of the
grave owner.

A fund for the preservation, care, upkeep and adornment of the
municipal cemetery in the City is hereby established and shall be
known and designated as the Perpetual Care Cemetery Fund.

All funds received by the City for the care and maintenance
of the cemetery shall be delivered to the City Collector and shall
be placed in a separate fund or account to be known as the Perpetual
Care Cemetery Fund.

All monies and funds placed in the Perpetual Care Cemetery Fund
shall be invested by the City Collector from time to time in bonds
of the United States Government or of the State, or may be placed
in any bank or savings and loan association which is authorized to
do business in this State so long as the funds so deposited are protected
by federal deposit insurance, as directed by ordinance duly passed
by the Board of Aldermen and approved by the Mayor.

All income received from the Perpetual Care Cemetery Fund shall
be expended and used only for the preservation, care, upkeep and adornment
of the municipal cemetery and the repurchasing of cemetery lots previously
sold.

The principal of the Perpetual Care Cemetery Fund shall not
be encroached upon for any purpose whatsoever, and no money shall
be transferred or appropriated out of such fund except for the purpose
of being invested as provided in this Article or for the repurchasing
of cemetery lots previously sold.

Any gift, donation or bequest to the Perpetual Care Cemetery
Fund shall be placed to the credit of the Perpetual Care Cemetery
Fund.
