A. 
No person, partnership or corporation shall operate a commercial animal establishment without first obtaining a business license from the City Clerk.
B. 
Any person, partnership or corporation operating a commercial animal establishment shall keep and maintain the animals, and all structures, pens, runs, or yards in which the animals are kept, in such a manner as to prevent a nuisance or health hazard to humans and to avoid injury to these animals. All cages and holding areas must be properly sanitized so as to keep the animals enclosed therein free of disease. Cages may be made of, but not limited to stainless steel, fiberglass or plastic. No wooden cages, painted or unpainted will be allowed. All such caged animals shall be provided with a constant supply of wholesome food and water, or in lieu of this, the proprietor shall prominently and publicly post and shall follow a schedule for adequate care of these animals, appropriate for their species, age and general health. All disease infested animals shall be removed and treated to prevent the spread of disease or, euthanized if required. If the owner or keeper fails or refuses to provide for such, the Chief of Police or his/her designee may remove such animals for disposition as provided by this Chapter, and the Commercial Animal Establishment license may be revoked.
C. 
When an applicant for a license shows the Chief of Police or his/her designee that he/she is willing and able to comply with the regulations herein, a license shall be issued upon payment of the applicable fee.
D. 
The license term shall be from May first (1st) to April thirtieth (30th). Renewal applications for licenses shall be made thirty (30) days prior to May first (1st) of each year. Application for a license to establish a new commercial animal establishment under the provisions of this Chapter may be made at any time during the year. Licenses issued during the year shall not be prorated.
E. 
Annual licenses shall be issued upon payment of the applicable fee:
1. 
Kennel authorized to house less than ten (10) dogs and/or cats: $30.00.
2. 
Kennel authorized to house ten (10) but less than fifty (50) dogs or cats: $30.00.
3. 
Kennel authorized to house fifty (50) or more dogs or cats: $30.00.
4. 
Pet shop: $30.00.
5. 
Riding stable: $30.00.
6. 
Auction: $30.00.
7. 
Zoological park: $30.00.
8. 
Circus: $30.00.
9. 
Performing animal exhibition: $30.00.
10. 
Grooming shop: $30.00.
F. 
Every facility regulated by this Chapter shall be considered a separate enterprise and requires an individual license.
G. 
No fee may be required of any veterinary hospital or government operated zoological park.
H. 
Any such person failing to obtain a permit before opening any facility covered in this Section shall be deemed guilty of an offense.
I. 
Any person who has a change in the category under which a license was issued shall be subject to reclassification and appropriate adjustment of the fee shall be made.

A. 
The City of Union may revoke any license if the person holding the license refuses or fails to comply with this Chapter, the regulations promulgated by the City, or any law governing the protection and keeping of animals, wild or domestic.
B. 
Any person whose license is revoked shall, within ten (10) days thereafter, humanely dispose of all animals, wild or domestic, owned, kept or harbored in accordance with this Chapter and no part of the license fee shall be refunded.
C. 
It shall be a condition of the issuance of any license that the Chief of Police or his/her designee shall be permitted to inspect all animals, wild or domestic, and the premises where animals are kept. If permission for such inspection is refused, revoke the license of the refusing owner.
D. 
If the applicant has withheld or falsified any information on the application, the City shall refuse to issue a license, or will revoke an existing license.
E. 
No person who has been convicted of cruelty to animals shall be issued a license to operate a commercial animal establishment.
F. 
Any person having been denied a license may not reapply for a period of thirty (30) days. Each reapplication shall be accompanied by a ten dollar ($10.00) fee.

There is hereby established in the City of Union a committee which shall have the responsibility of investigating allegations regarding the existence of dangerous animals which shall be known as the Public Safety Committee. The Public Safety Committee shall be comprised of the Chief of Police and, if possible, two (2) doctors of veterinary medicine. The members other than the Chief of Police shall be appointed by the Mayor on an annual basis. If there are no doctors of veterinary medicine who are willing to serve on such Committee, the Mayor shall submit to the Board of Aldermen the name or names of individuals who have experience in either law enforcement, public health or public safety to fill such vacancies so that there will always be three (3) members of the Committee. The Chief of Police shall serve as the Chairman of such Committee and shall call a meeting thereof as soon as possible after receiving notice of the existence of a animal which is alleged to be dangerous. The Committee shall at such meeting determine whether or not the animal in question is dangerous and shall so inform the owner of such finding. If reasonably possible, the Committee shall provide notice of the time, date and place of the meeting to the owner of the animal in question. The owner shall have the right to appear at such meeting.
