The Board of Aldermen hereby finds and declares that exterior wood-burning furnaces, as herein defined, are a threat to the general public health, safety and welfare and are hereby prohibited within the corporate limits of the City of Union, Missouri, with the exception of those properties zoned "NU" Non-Urban District.

For the purposes of this Chapter, an "exterior wood-burning furnace" shall mean any device used to supply heat to a structure which uses wood or any wood by-product as its source of fuel, in whole or in part, and which is not located within a building which is the principal use on a lot or lots.

The City Engineer or his or her designated representative shall cause any person or entity which erects, constructs or places into use any exterior wood-burning furnace after February 11, 2002, to be served a notice advising such person or entity that such exterior wood-burning furnace is in violation of this Section and is prohibited by ordinance within the corporate limits of the City of Union, Missouri. Such notice shall advise any such person or entity that the offending exterior wood-burning furnace must be removed within fifteen (15) days of such notice.

Any person who violates this Chapter by failing to remove any exterior wood-burning furnace shall be punishable under the provisions of Section 100.150 of the Code of Ordinances of the City of Union, Missouri.
