The following words, whenever used in this Chapter, shall be
construed as defined in this Section:
The City of Union.
A park, reservation, playground, recreation center or any
other area of the City, owned or used by the City, and devoted to
active or passive recreation.
A permit for exclusive use of parks or portion thereof, or
buildings, or portion thereof, as provided for and defined in this
Chapter.
Includes persons, associations, partnerships, firms and corporations,
or any company or organization of any kind.
Any wheeled conveyance whether motor-powered, animal-drawn
or self-propelled. The term shall include any trailer in tow of any
size, kind or description. Exception is made for baby carriages and
vehicles of the City.

A.
No
person in a City park shall:
1.
Willfully mark, deface, disfigure, injure, tamper with or displace
or remove, any buildings, bridges, tables, benches, fireplaces, railings,
paving or paving materials, water lines or other public utilities
or parts or appurtenances thereof, signs, notices or placards whether
temporary or permanent, monuments, stakes, posts, or other boundary
markers, or other structures or equipment, facilities, or park property
or appurtenances whatsoever, either real or personal.
2.
Dig, or remove any soil, rocks, stones, trees, shrubs, or plants,
down timber or other wood or materials, or make any excavation by
tool, equipment, blasting, or other means or agency, except in designated
areas.
3.
Construct or erect any building or structure of whatever kind, whether
permanent or temporary in character, or run or string any public service
utility into, or upon or across such lands, except on special written
permit.
4.
Damage, cut, carve, transplant, or remove any trees or plants or
injure the bark, pick flowers or seeds, of any tree or plant; or attach
any rope, wire, or other contrivance to any tree or plant; or dig
in or otherwise disturb grassy areas, nor in any way injure or impair
the natural beauty or usefulness of any area.
5.
Hunt, molest, harm, trap, kill, shoot at any animal, reptile or bird;
or remove the eggs or nest or young of any bird.
6.
Give or offer to give any animal or bird any noxious substance.
7.
Use, possess, or bring into any City park any glass bottle or container.
8.
Climb any tree or walk, stand or sit upon monuments, vases, fountains,
railings, buildings, fences or upon any other property not designated
for such purposes.

A.
Hunting Prohibited. No person in a park shall hunt, trap
or pursue wildlife at any time; or use, carry, or possess firearms
of any description, or air rifles, spring guns, bow and arrows, slings
or any other type of weapon capable of launching a dart, bullet, arrow
or stone; or any instrument that can be loaded with and fire blank
cartridges, or any kind of trapping device. Exception: Police Officers as required by law.
B.
Use Of City Lake. No swimming is allowed in the City lake.
No boating without special written permission. Persons fishing must
possess a valid Missouri fishing license and observe all State fishing
laws. Use of seines, jug-lines, trot lines, gigs, nets, limblines,
traps or any other device other than use of hook and line to obtain
fish from park waters is not permitted.

A.
No
person in a park shall ride or drive a vehicle at a rate of speed
exceeding the posted speed limit nor shall they at any time drive
any vehicle on any area except the paved park roads, or parking areas,
or other such areas as may on occasion be designated as temporary
parking areas by the City; or park a vehicle in other than established
or designated parking areas. Exception: Park personnel
in performance of their duties.
B.
No
person in a park may park or cause to be parked any vehicle on grassy
areas except by special permit. Vehicles must be parked in areas designated
for such use. Exception: City vehicles as required
in course of work or as excepted.

A.
No
Swimming. No swimming is allowed in the City lake. No person shall
swim, dive or wade in any lake, pond or stream within any park, except
places that are provided therefor.
B.
No
Ice Skating. No person shall be allowed to ice skate on the City lake
or any other impoundment of water owned or maintained by the City
of Union.

Fires may be built in receptacles and facilities intended therefore,
unless permission is secured in writing. Patrons may use their own
portable "bar-b-que" braziers in areas designated and so posted. No
person who has built any such fire shall leave the area where the
fire was built without first extinguishing the fire. No person shall
drop, throw, or scatter lighted matches, burning cigarettes or cigars,
tobacco, papers, or other flammable material within any park area.
Fires may be prohibited entirely by the posting of special notices.

Camping is prohibited in all City parks, except by written permission.

A.
Domestic
animals are allowed in City parks only if the following conditions
are met:
1.
No leash on which a dog or cat is tethered may be longer than six
(6) feet in length, and held by a competent person.
2.
No person shall permit a domestic animal to run loose.
3.
No vicious animal of any kind shall be brought into the park at any
time even though restrained as described above.
4.
No animal shall be tethered to any bush, tree, shrub or to any park
structure. Neither shall any person run any animal behind any motor
vehicle or bicycle or any other vehicle, whether on a leash or not.

A.
No
person in a City park shall:
1.
Throw, discharge, or otherwise place or cause to be placed in the
waters of any fountain, pond, lake, stream, storm sewer, or drain
flowing into such waters, any substance, matter or thing, liquid or
solid, which will or may result in pollution of such waters.
2.
Litter, or cause to be littered any of the grounds, driveways, buildings
or other structures of the parks, by scattering, dumping or leaving,
paper, garbage, cans, broken glass, bottles, ashes, rubbish, waste,
or other trash. All such rubbish or waste shall be carried away from
the park by the person responsible for its presence and properly disposed
of elsewhere.
3.
Use park trash receptacles for deposit of garbage or other rubbish
brought from their place of residence or work.

No person shall solicit alms or contributions for any purpose
whatsoever, whether public or private, within any of the parks, except
by written permission, when such solicitations are of direct benefit
to the City parks and recreational programs.

No person shall play or practice golf in any area of a park
not designated for such use.

A.
No
person in a park shall:

A.
No person in any City public park shall be allowed to remain in or
enter a City park in an intoxicated condition, or under the influence
of drugs at any time.
B.
No illegal drugs of any kind or description will be tolerated in
any City park at any time; except for prescription drugs legally in
the possession of a person.
C.
No minor shall possess or consume any intoxicating beverage or tobacco
product.
D.
No person shall smoke or use an electronic vapor device within twenty-five
(25) feet of any buildings, pavilion, pool, splash park, docks, gazebos,
restrooms, at any time, nor any sports field, or their surrounds,
during any scheduled/organized sporting event, game/tournament in
any City park.
E.
A sports field or its surrounds, shall include any fence or area
used for player/public seating and considered part of the field of
play which would include dugouts, outfield, infield and foul territory
for baseball/softball areas, and the playing field and sidelines within
twenty-five (25) feet of any soccer or football field, concession
stand, seating area, or walking paths.
F.
Parties renting any pavilion for a private event shall be privileged
to allow smoking or the use of electronic vapor devices for that private
party only, but shall be liable for cleanup or damages from same.

Permits for use of specific areas in a City park may be obtained
by calling the Park Office. A deposit is due within one (1) week of
reservation and full payment is due four (4) weeks in advance. Certain
activities may require written permission, hold harmless agreements
and certificates of insurance.

Union City parks shall be open for public use from 6:00 A.M.
until one-half (½) hour after dusk. Only participants (including
spectators) in authorized, scheduled activities will be allowed to
remain in the parks after dark, but no later than 12:00 Midnight,
unless special written authorization is granted.

No person shall enter, be or remain in any park or building
of the City unless he or she complies with all of the regulations
set forth in this Chapter applicable to such parks or buildings.

The provisions of this Chapter shall not be applicable to City
park employees while actually engaged in their official duties, nor
shall the provisions of this Chapter apply to Board members or City
Officials while attending to City business.

A.
The
Director and any authorized park attendant shall have the authority
to eject from the park any person acting in violation of this Chapter.
B.
The
Director and park attendants shall, in connection with their duties,
diligently cooperate with the Police Department to insure the enforcement
of the provisions of this Article.
C.
Any
person violating any of the provisions of this Article is guilty of
an ordinance violation and upon conviction shall be punished by a
fine, not to exceed five hundred dollars ($500.00).
