A. The
election day for the election of City Officers shall be the first
(1st) Tuesday after the first (1st) Monday in April each year; and
shall be known as the "general municipal election day.
B. Propositions
for consideration by City electorate, and any special elections to
fill vacancies in any elective office, shall be held on such date
as shall have been determined by the Board of Aldermen consistent
with the provisions of Section 115.123, RSMo.
C. The
Board of Aldermen may provide, in accordance with Sections 115.121
through 115.129, RSMo., as amended, for a special election whether
for the purpose of considering propositions or filling a vacancy in
office by ordinance. The City Clerk shall give timely notice to the
County Board of Election Commissioners pursuant to Section 115.125,
RSMo., as amended.

A. Any person possessing the requirements for a candidate to an elective office in the City may secure from, and file with, the City Clerk, during the period for filing, a candidate's application form. The candidate's application form generally adopted by the Board of Aldermen in Section
105.030 shall be entitled "Declaration of Candidacy for Municipal Election".
B. No
candidate shall be considered as having filed for an elective office
unless he/she completes such form, signs it, and affirms the information
thereon in the presence of the City Clerk, and, unless he/she shall
have the City Clerk attest his/her signature and record the time and
date of filing in the space provided. A candidate shall receive from
the City Clerk an exact duplicate copy of the form he/she filed, provided
it shall be timed, dated and attached by the Clerk.
C. The
City Clerk shall not refuse a candidate's application for any reason;
provided however, the City Clerk, if he/she deems the application
erroneous or improper, shall note the error, or impropriety, above
his/her attestation. The Clerk shall preserve in his/her file the
original of the set of forms filed by each candidate respectively
for two (2) years after the date of the election for which a candidate's
declaration was made.
D. A candidate
for any office to be filled at the City election shall properly file
his/her declaration of candidacy for municipal election no earlier
than 8:00 A.M. the 17th Tuesday prior to the election, and not later
than 5:00 P.M. the 14th Tuesday prior to the election, or as established
by Section 415.127, RSMo.The City Clerk shall accept only such declarations
for filing which are submitted during the period set forth above in
the office of the City Clerk during the regular work hours of such
office.
E. Pursuant to Section 115.359, RSMo., the name of a person who has properly filed a declaration of candidacy and who has not given written notice of withdrawal to the City Clerk as outlined generally in Section
105.030 prior to certification shall, except in case of death or disqualification, be printed on the general election ballot.
F. Except as provided for in Sections 115.247 and 115.359, RSMo., if there is no additional cost for the printing or reprinting of ballots or if the candidate agrees to pay any printing or reprinting costs, a candidate who has filed for an office or who has been duly nominated for an office, may, at any time after the certification required in Section 115.125, RSMo., but no later than 5:00 P.M. on the 8th Tuesday before the election, withdraw as a candidate pursuant to a court order, which, except for good cause shown by the election authority in opposition thereto, shall be freely given upon application by the candidate to the Circuit Court of the area of such candidate's residence. No withdrawal shall be effective until such candidate files written notice or a copy of the court's order, outlined in Section
105.020(F) in the office of the official who accepted such candidate's declaration of candidacy.

Candidates for Mayor in a City election shall use the form designated
"Mayor's Form," as generally set forth in this Section, and candidates
for Alderman shall use the form designated "Alderman's Form," as generally
set forth in this Section. Each form may be amended from time to time
by the City Clerk to ensure compliance with State law and applicable
Code changes.

The City Clerk shall file, on forms provided by the County Board of Election Commissioners, his/her certification of candidates and/or propositions, with the notice to the County Board of Election Commissioners as specified in Section
105.010 of this Chapter, or at such other time as may be ordered by the Board of Aldermen not inconsistent with Sections 115.121 through 115.129, RSMo., as amended, and any regulations which may have been adopted by the County Board of Election Commissioners.
If the candidates who received an equal number of votes in such
election agree to the procedure prescribed in this Section, the officer
with whom such candidates filed their declarations of candidacy may,
after notification of the time and place of such drawing given to
each such candidate at least five (5) days before such drawing, determine
the winner of such election by lot. Any candidate who received an
equal number of votes may decline to have his/her name put into such
drawing.

All requirements and duties of the City Clerk under this Chapter
may be performed by an assistant or Deputy City Clerk.

The City is hereby divided into four (4) Wards. A detailed description
of the boundaries of such Wards is on file at the office of the City
Clerk in the municipal center.
