SERVICE STATION
For purposes of this Article, is defined as an operation within the City providing a limited service to automobiles, trucks, buses or any other vehicle, including but not limited to storage and sale of gasoline, oil, tires, automobile accessories and incidentals, and such automobile repairs as are required to make a motor vehicle safe on the roads.

Any person, before operating a service station shall obtain a license, issued annually. The annual fee for such license shall be such amount as shall be calculated under the provisions of Chapter 605 of this Title. The applicant shall file his/her license application (or renewal application) together with the license fee with the City Clerk who shall refer the application (or renewal application) to the Board of Aldermen.

A. 
The owner, operator, manager, lessor and/or lessee, of every service station shall be and hereby is charged with maintaining and operating the premises in a safe and orderly condition to minimize the hazards of fire, explosion, vehicular and/or pedestrian traffic; and further, to prevent the premises from becoming a nuisance and burden to the surrounding property and the community at large by providing for a daily cleanup of debris, trash, discarded materials, and by providing metal, completely enclosed containers, for temporary storage of such materials. Further, no dangerous or noxious fumes, odors or gases shall be permitted to be on, or to flow from the premises, and noise, lights and motor testing shall be conducted so as to cause a minimum of inconvenience to adjoining property and the community at large.
B. 
All gasoline storage shall be in compliance with the City Fire Code.

A. 
Service stations which are located within two hundred fifty (250) feet of any residential property shall be closed between the hours of Midnight and 6:00 A.M. local time.
B. 
In the event this Section is violated, the person responsible for operating the facility at the time of violation, or the owner of the facility, may be charged with violating this Code and, upon conviction, shall be subject to the penalties as provided in Section 100.150.
