For purposes of this Chapter, a "swimming pool" is defined as an artificial pool of water, wading pool or spray pool which shall have a water capacity of at least one thousand (1,000) gallons.

Any person owning, controlling, managing or maintaining a swimming pool shall be in compliance with proper health standards in accordance with all the requirements, rules and regulations of the Department of Public Health of the State of Missouri, and all requirements, rules and regulations of the Department of Health of St. Louis County, Missouri.

It shall be unlawful for any person to own, control, manage or supervise any swimming pool, unless it is completely surrounded by a guard or fence of no less than four (4) feet nor more than six (6) in height and at least four (4) feet from each side of such pool. Such guard or fence shall be constructed sufficiently strong and of such design so as to prevent such pool from being readily accessible.

Any person owning, controlling, managing, or supervising any swimming pool, in whole or in part, shall be responsible for the conduct of persons upon said premises or using said swimming pool in that said persons thereon shall not annoy or disturb the quiet, comfort or repose of persons in the vicinity, particularly between the hours of 10:00 P.M. and 8:00 A.M.

Any person owning, controlling, managing or supervising any swimming pool, in whole or in part, shall, when draining water from the pool, cause said water to be drained only into a sanitary sewer system.

The Director of Health of St. Louis County, or his/her representative, shall have the right at all reasonable times and as frequently as he/she may deem advisable, to enter upon any portion of the premises pertaining to swimming pools for the purpose of inspecting the same and ascertaining if the swimming pool is being maintained in accordance with approved health standards.
