The purpose of this article is to grant a partial exemption
from real property taxes to property damaged from the effects of the
October 29, 2012, "super storm" known as Hurricane Sandy for those
properties for which taxes were paid in full for the tax year 2013-2014.
Those properties for which there is any outstanding unpaid taxes shall
not be eligible for a partial exemption.
This article is adopted pursuant to New York State Real Property
Tax Law Article 7 and Local Finance Law Section 11, Subdivision 33-6,
permitting the Village of Lindenhurst to adopt a local law to allow
for the stated intent and to permit the issuance of bonds, if deemed
necessary, to fund tax revenue lost by such assessment reductions.
A.
This article shall authorize the establishment of an application
and hearing review process to determine the eligibility of those properties
to receive such exemptions in accordance with the following assessment
reduction schedule:

B.
The Board of Assessment Review shall have the final authority to
grant or deny an application submitted pursuant to this article.
If an application for a partial exemption is granted for the
assessment period of 2013-2014, the Village of Lindenhurst may issue
a combination of a direct refund, a credit against further taxes or
a combination of both as the Village of Lindenhurst deems necessary
and appropriate.
If a court determines that any clause, sentence, paragraph,
subdivision, or part of this article or the application thereof to
any person, firm or corporation, or circumstance is invalid or unconstitutional,
the court's order or judgment shall not affect, impair, or invalidate
the remainder of this article, but shall be confined in its operation
to the clause, sentence, paragraph, subdivision, or part of this article
or in its application to the person, individual, firm or corporation
or circumstance, directly involved in the controversy in which such
judgment or order shall be rendered.
This article shall take effect immediately upon filing with
the Secretary of State. The deadline for any property owner to make
an application pursuant to this article is January 21, 2014.
