A. 
The Town Board finds that to protect the health, safety and general welfare of the Town of Grand Island and its citizens, there is a need to address the special aesthetic, crowding and display conditions caused by the outdoor display of motor vehicles, large equipment and similar merchandise in the Town of Grand Island.
B. 
The Vehicle Sales Overlay District is an overlay zoning district which shall be used in combination with the underlying districts provided in this zoning code. The purpose of the Vehicle Sales Overlay District is to regulate, retain and expand a major component of the Town's commercial and employment base by regulating vehicle sales and similar uses by requiring an environment that provides an attractive shopping experience for the purchase of vehicles and equipment, while maintaining aesthetic standards for sales facilities requiring the outdoor display of merchandise.
C. 
This purpose is to be accomplished by:
(1) 
Using a right-of-way and setback area improvement design to help create a unique, attractive and visually cohesive shopping district which showcases and emphasizes the sale and appeal of new and used vehicles while preserving the functionality of the streets and improving the amount of and access to parking;
(2) 
Using the required setback areas to preserve future right-of-way needs and provide required landscaping to enhance the aesthetic appeal of the commercial area of the Town;
(3) 
Providing safe and convenient access between and within all development in the district;
(4) 
Providing landscaping which visually enhances both on-site and off-site development;
(5) 
Providing public sidewalks to and through adjoining properties, where appropriate;
(6) 
Creating review procedures that establish the authority to review, recommend and approve proposed improvement projects within the Vehicle Sales Overlay District;
(7) 
Requiring substantial permanent structures in connection with any allowed use;
(8) 
Establishing special site development standards for the district.
As used in this article, the following terms shall have the meanings indicated:
EQUIPMENT
Any vehicles, trailers, building materials, or any other material, the bulk or size of which requires outdoor storage or display.
SALES
Sales, rental, leasing or brokering.
VEHICLE
Any use regulated by this chapter, including equipment as defined herein. Excluded from this definition are temporarily displayed smaller items such as lawn furniture, landscaping plants, and materials.
A. 
The Vehicle Sales Overlay District shall include all land as specified on the official Zoning Map of the Town of Grand Island as B-1 District, and as established as an overlay zone by rezoning, and is within view of a major highway.
B. 
This provisions and regulations of the Vehicle Sales Overlay District are in addition to all other provisions and regulations of the zoning code which apply to the underlying zoning as determined on the official Zoning Map of the Town. All property within this overlay district will have the requirements of both the underlying and this overlay zoning districts in addition to other requirements regulating the use of land whenever the provisions of the Vehicle Overlay District apply. This overlay district shall be superimposed over existing zones. each use must conform to the development standards required by the underlying zoning district as well as this overlay district, and the more stringent standard shall control.
C. 
Uses. The following uses are regulated by the Vehicle Sales Overlay District:
(1) 
New and pre-owned automobile sales;
(2) 
New and pre-owned recreational vehicle sales which involve outdoor storage or display of inventory;
(3) 
New and pre-owned water vessel sales, which involve outdoor storage or display of inventory;
(4) 
New and pre-owned farm equipment sales;
(5) 
New and pre-owned construction equipment sales;
(6) 
New and pre-owned truck sales;
(7) 
Any other use requiring or allowing outdoor display of equipment as a principal or usual activity;
(8) 
Any use permitted as accessory to or in combination with Subsection C(1) through (7) above.
A. 
Vehicle Sales Overlay District site development standards shall be incorporated into any project plans submitted to the Town.
B. 
Signs in the Vehicle Sales Overlay District shall be in accordance with the Town Sign Code, Chapter 295.
