A. 
The Board of Aldermen of the City of Platte City deems it necessary for the purpose hereunder to update their comprehensive zoning ordinance for the City of Platte City:
1. 
To promote health, safety, morals and a general welfare of the community including its aesthetic appearance.
2. 
To lessen congestion in the streets.
3. 
To secure safety from fires, panic and other dangers.
4. 
To provide adequate light and air.
5. 
To prevent the overcrowding of land.
6. 
To avoid undue concentration of population.
7. 
To bring about the gradual conformity of the uses of land and buildings throughout the City.
8. 
To facilitate the adequate provision of transportation, water, sewage, schools, parks and other public requirements.
9. 
To protect and conserve the value of land throughout the City by allowing the commercial districts to permit commercial uses only and by allowing the industrial districts to permit industrial uses only and by concentrating the residential uses within the residential districts.
10. 
To provide a policy to efficiently process all permits and other application forms by the City.
11. 
To continue to regulate and restrict the use of land located in areas designated as floodplains.

This Chapter shall be known and may be cited as "The Platte City Zoning Ordinance".

A. 
For the purpose of regulating and restricting use of land and the erection, construction, reconstruction, alteration or use of buildings, structures or land, the City of Platte City is hereby divided into districts as follows:
1. 
District "A-1" Agriculture District
2. 
District "R1-40" Low Density Single-Family Residential District
3. 
District "R1-16" Medium Density Single-Family Residential District
4. 
District"R1-8" High Density Single-Family Residential District
5. 
District "R-2" Two-Family Residential District
6. 
District "R-3" Multi-Family Residential District with Between Three and Eight Units
7. 
District "R-4" Multi-Family Residential District with Greater than Eight Units
8. 
District "RCD" Residential Conservation District
9. 
District "C-1" Central Business District
10. 
District "CCD" Commercial Conservation District
11. 
District "C-2" General Commercial District
12. 
District "C-R" Commercial-Residential District.
13. 
District "AE" Adult Entertainment Overlay District
14. 
District "M-1" Light Industrial District
15. 
District "M-2" General Industrial District
B. 
Legal descriptions of these districts are set forth in Section 405.1005 of this Title. Land subsequently annexed shall be classified as "A-1."

A. 
In their interpretation and application, the provisions of this Chapter shall be held to the minimum requirements for the promotion of the public health, safety, morals and welfare of the citizens of Platte City, Missouri.
B. 
Where the conditions imposed by any provision of this Chapter upon the:
1. 
Use of land or buildings,
2. 
The bulk of buildings,
3. 
Floor area requirements,
4. 
Lot area requirements, and
5. 
Yard requirements
are either more restrictive or less restrictive than comparable conditions imposed by any other provision of this Chapter or of any other law, ordinance, resolution, rule or regulation of any kind, the regulations which are more restrictive or which impose higher standards or requirements shall govern.
C. 
This Chapter is not intended to abrogate any easement, covenant or other private agreement; provided that where the regulations of this Chapter are more restrictive or impose higher standards or requirements than such easements, covenants or other private agreements, then the requirements of this Chapter shall govern. Where the provisions of the easement, covenant, private agreement or restrictions impose duties and obligations more restrictive or higher standards than the requirements of this Chapter or determinations made thereunder, then such private provisions shall be operative and supplemental to the provisions of this Chapter and determinations made thereunder.
D. 
No building, structure or use lawfully existing at the time of the adoption of this Chapter shall become or be made lawful solely by reason of the adoption of this Chapter; and to the extent that and in any manner that said unlawful building, structure or use is in conflict with the requirements of this Chapter, said building, structure or use remains unlawful hereunder.

A. 
It is hereby declared to be the intention of the Board of Aldermen of the City of Platte City, Missouri, that the several provisions of this Chapter are separable (meaning that the Board of Aldermen of the City of Platte City hereby declares that they would have enacted the remainder of this Chapter even without any such part, provision or application), in accordance with the following:
1. 
If any court of competent jurisdiction shall adjudge any provisions of this Chapter to be invalid, such judgment shall not affect any other provision of this Chapter not specifically included in said judgment.
2. 
If any court of competent jurisdiction shall adjudge invalid the application of any provision of this Chapter to a particular property, building or other structure, such judgment shall not affect the application of said provision to any other property, building or structure not specifically included in said judgment.
B. 
If any portion of this Chapter is declared unconstitutional or if this Chapter is declared unconstitutional as it applies to a particular parcel, the prior Platte City Zoning Code (that was repealed upon the enactment of the present Platte City Zoning Code) will be automatically "revived" as to those applicable portions.

This Zoning Chapter shall not be construed as abating any action now pending under, or by virtue of, prior existing ordinances or as discontinuing, abating, modifying or altering any penalty accruing or to accrue or as affecting the liability of any person, firm or corporation or as waiving any rights of the City under any Section or provision existing at the time of adoption of this order or as vacating or annulling any rights obtained by any person, firm or corporation by lawful action of the City, except as shall be expressly provided for in this order.

A. 
The following uses of land or buildings are allowed in the districts as described under the conditions specified in this Chapter:
1. 
Uses lawfully established on the effective date of this Chapter.
2. 
Uses as designated throughout this Code.
