Such use is subject to City business license restrictions and State regulations governing the establishment and operation of medical marijuana cultivation and/or processing facilities and such conditions as may be necessary to preserve and protect the public safety.
[Zoning Regs. §13.020; Ord. No. 1014 §3, 6-12-1998]
A. 
In District "M-1" for any building or structure hereinafter erected, moved or altered, the height of a building and the minimum dimensions of lots and yards shall be as follows: (for exceptions see Article XVII — Height and Area Exceptions)
1. 
Height. Buildings or structures shall not exceed thirty-five (35) feet in height or three (3) stories.
2. 
Yards.
a. 
Front yard. The depth of the front yard shall be at least twenty (20) feet from the front lot line except when adjoining a residential district in which case the maximum front yard shall be the same as "R-1".
b. 
Side yard. None; except when adjacent to a residential district in which case the maximum side yard shall be ten (10) feet.
c. 
Rear yard. The depth of the rear yard shall be at least ten (10) feet from the rear lot line.
3. 
Lot width. The minimum width of a lot shall be eighty (80) feet.
4. 
Lot area. The minimum lot area shall be eight thousand (8,000) square feet.
5. 
Buffer zone. Every tract zoned "M-1", which in any way adjoins, abuts or is adjacent to any other district, shall have a buffer zone, as defined herein, along the boundary line between the two (2) districts or if said boundary line is the center of a street, along the edge of the street right-of-way abutting "M-1" District.

A. 
The following standards shall be enforced in this district:
1. 
All operations shall be conducted within a fully enclosed building.
2. 
Outside storage. No outside storage shall be permitted unless the applicant shall first obtain a conditional use permit. A conditional use permit shall be subject to the following conditions:
a. 
All storage of materials, products or equipment, except that for retail sale on the premises, shall be within a fully enclosed building or in a fenced open yard adequately screened.
b. 
All storage of materials or products for retail sale on the premises shall be kept off the public sidewalks and street. No such product or materials shall be stored within ten (10) feet of a street line.
c. 
All storage of equipment, materials and products shall be stored in a lot in strict compliance with Section 405.475(G). (Storage lot hard surfacing requirements.)
d. 
All storage of equipment, materials and products shall be conducted in a neat and orderly fashion.
e. 
Construction trailers. No construction trailers or trailer offices shall be permitted. Nor shall trailers be used for storage, without a conditional use permit which shall not exceed a period of six (6) months. A construction trailer or trailer office associated with a current building project having already obtained a building permit is allowed.
3. 
No smoke or particulate matter shall be discharged of a number one (1) or darker on a Ringlemann chart.
4. 
No smoke, radiation, vibration or concussion, heat or glare shall be produced that is perceptible outside a building and no dust, fly ash, gas or other substances that are toxic, caustic or injurious to humans or property shall be produced.
5. 
No noise shall be produced that exceeds eighty (80) db beyond any building or property line.
6. 
No waste shall be produced which causes damage to the public sewer or the treatment facility or which will over burden the existing public or private sewage disposal facilities or cause odor or unsanitary effect beyond the property line. No toxic or flammable or hazardous material shall be deposited in the sewer. The applicant shall submit a disposal plan for any toxic, flammable or hazardous material which will be produced on the premises.
7. 
No building or structure shall be operated which does not provide for adequate and sufficient drainage. The applicant shall at the time of his/her application submit a drainage plan together with the application in sufficient detail to determine that there is adequate water drainage and storm sewers.
8. 
No use shall be permitted which manufactures or stores toxic, hazardous or explosive products. However, if at the discretion of the zoning enforcement person a finding is made that the use will not cause endangerment to the residents of the City of Platte City, then the use may be allowed. To define hazardous, see Platte City's currently enacted Building Code.
9. 
All outdoor trash containers and dumpsters shall be properly screened within solid wall enclosures. For exceptions, see Section 405.560(B).
10. 
No building shall be used for residential purposes.
11. 
Industrial subdivisions shall meet any additional requirements contained in the subdivision regulations of the City of Platte City, Missouri, as they now exist or may be hereinafter enacted.
12. 
No accessory buildings shall be permitted, unless expressly allowed by some other provision of this Zoning Code.
13. 
No person shall consume or drink any intoxicating liquor of any kind or any beer on any public street, sidewalk, park or on the outside of any other public place which does not have a liquor license permitting outside consumption.

A. 
No building that was designed and constructed as a residential building shall be converted for use as an office building or other business purposes unless the following conditions are met:
1. 
Setbacks comply with those required in this district.
2. 
All off-street parking required by this Chapter or by the proposed use of the premises can be accommodated in the side or rear yard and have access and dimensions to permit the full and safe use thereof.
3. 
The building is made to comply with all building and other code requirements.
4. 
All necessary permits are obtained, including a building permit.
5. 
A site plan depicting the above requirements plus any changes to the interior of the building shall be prepared by a professional architect or professional engineer registered in the State of Missouri and submitted for review and approval by the Planning Commission prior to issuance of permits.

A. 
Exterior Walls — Facade.
1. 
All exterior walls of a building or structure which are visible from any road, street, highway or interstate highway shall be faced with brick veneer, stone, glazed tile or veneering or finish material as shall be approved by the Planning Commission and Board of Aldermen.
2. 
All exterior walls of a building or structure which are not visible from any road, street, highway or interstate highway shall be painted so that no unfinished, uncolored, undecorated exterior walls are visible. This shall be approved by the Planning Commission and Board of Aldermen.
B. 
Landscaping And Screening Regulations. In this district, the applicant shall be required to follow the landscaping and screening requirements set forth in Article XIX Landscaping and Screening.
C. 
Appearance. In addition to the above, any applicant within three hundred (300) feet of any existing highway or street or within three hundred (300) feet of any boundary of commercial or residential zoning shall provide a detailed profile of the outside of the building or structure which shall be sufficiently definitive to assure the aesthetic development of the area.
D. 
Roofs. The following regulations shall apply to roofs within this district:
1. 
The roof shall be structurally sound, tight, shall not admit rain and drainage shall be sufficient to carry water away from the roof.
2. 
All downspouts and gutters shall be kept in good repair.
3. 
Galvanized roofs are not permitted, except as provided by the Planning Commission for accessory buildings.
4. 
All roofs shall be constructed of materials of quality and appearance approved by the Planning Commission.

A. 
General. For all dwellings, buildings or structures hereafter erected, constructed, reconstructed, altered or improved upon in District "M-1", provisions shall be made in the form of garages, carports or open parking areas for the parking of motor passenger vehicles which shall conform with the requirements set forth in this Section and Article XVIII.
B. 
Determination Of Required Number Of Spaces.
1. 
Number of parking spaces required. To determine the minimum amount of parking spaces required, first see Section 405.520. If Section 405.520 does not list the particular use, the minimum amount of parking spaces required is one (1) off-street parking space for each two (2) employees or one (1) space for each one thousand (1,000) square feet of the gross building size (whichever is greater).
2. 
Reserved space. In addition to the provided space for parking, there shall be reserved space for each establishment equal to one (1) parking space for each three hundred (300) square feet of floor area or one (1) parking space for each employee, whichever is greater.
Exception: When more than one (1) working shift is anticipated, then there shall be one (1) reserved parking space for each three hundred (300) square feet of floor area or one (1) parking space for each employee based on the largest working shift in any twenty-four (24) hour period.
This reserved space shall be appropriately landscaped pending the requirement of its use as provided parking space.
3. 
Fractional spaces. When determination of the number of off-street parking spaces required by this regulation results in a requirement of a fractional space, the fraction of one-half (½) or less may be disregarded and a fraction in excess of one-half (½) shall be counted as one (1) parking space.
4. 
Utilization. Required accessory off-street parking facilities provided for the uses hereinafter listed shall be solely for the parking of motor vehicles in operating condition of patrons, occupants or employees.
C. 
Parking Space. A parking space shall be (exclusive of driveway, alley, street) eight and one-half (8½) feet in width by eighteen (18) feet in length. For handicapped spaces, see Subsection (D). A parking space shall be connected with a street or alley by a surfaced driveway which affords satisfactory ingress or egress for automobiles.
D. 
Parking Facilities For Handicapped. Parking facilities shall be provided for the physically handicapped for all establishments used by the general public, employees or visitors.
1. 
Spaces required. One (1) handicapped parking space shall be required for each business identified by above grade signs as reserved for physically handicapped persons. Each reserved space shall be at least twelve (12) feet wide and at least twenty (20) feet long.
2. 
Location. Parking spaces for the physically handicapped shall be located as close as practical to elevators, ramps, walkways and entrances. Parking spaces should be located so that the physically handicapped persons are not compelled to wheel or walk behind parked cars to reach entrances, ramps, walkways and elevators.
3. 
Curbs. Where a curb exists between a parking lot surface and a sidewalk surface, an inclined curb approach or a curb cut with a slope of not greater than one (1) unit vertical to twelve (12) units horizontal shall be provided for wheelchair access.
E. 
Design Standards For Parking Lots.
1. 
Twenty-five percent (25%) of the required off-street parking spaces may be designed for compact cars. Such spaces shall be grouped in one (1) location, identified by signs as reserved for compact cars only and located reasonably close to building entrances in order to encourage utilization. When parking spaces for compact cars are utilized, then the square feet of required parking may be reduced by ten percent (10%).
2. 
Compact off-street parking spaces shall comply with the design standards contained in the off-street parking standards of this Article.
F. 
Maneuvering Spaces. Each required off-street parking space shall open directly upon an aisle or driveway of such width and design as to provide safe and efficient means of vehicular access to such parking space.
1. 
Driveways. Ingress and egress for parking areas providing space for five (5) or more vehicles shall be by means of driveways with a minimum width of twenty-five (25) feet and a maximum width of thirty-five (35) feet and shall be paved as provided in Section 405.325(I). Head-in parking from any public right-of-way shall not be permitted.
2. 
Aisles. Standing areas, aisles for maneuvering and entrance and exit roadways shall not be computed as parking space and shall be provided in addition to required parking space as required in site plan approval. Parking spaces shall have a vertical clearance of at least seven (7) feet six (6) inches and shall be measured at right angles to the axis of the vehicle. Aisles shall not be less than twenty-four (24) feet wide for ninety degree (90°) parking, eighteen (18) feet wide for sixty degree (60°) parking, fifteen (15) feet wide for forty-five degree (45°) parking (angle shall be measured between centerline of parking space and centerline of aisle) and twelve (12) feet wide for parallel parking. For parallel parking, the length of the parking space shall be increased to twenty-three (23) feet.
G. 
Storage Area. The City of Platte City requires that areas used for the temporary, self-storage or permanent storage of any item:
1. 
Shall be at the very minimum hard surfaced with a ninety-five percent (95%) compacted base that is a minimum of four (4) inches of one and one-half (1½) inch rock and covered with a bituminous material with aggregate cover. The applicant shall also consult the Missouri Standard Specifications for Highway Construction (1986 and amendments) and if a higher standard is required for the construction of the storage area, this higher standard from the Missouri Standard Specifications for Highway Construction shall apply. If a lower standard is set forth in the Missouri Standard Specifications for Highway Construction, it shall not apply and the applicant shall follow the minimum standards set forth in this paragraph. All construction shall be in accordance with good general engineering practice; and
2. 
Shall be adequately screened taking into consideration the visibility of the storage area from any street, highway or interstate; and
3. 
Shall have a fence around the outside boundaries of the storage area that complies with the following requirements:
a. 
Entrance is through a gate that is locked during non-business hours; and
b. 
It is constructed of chain link fence or sufficient substitute; and
c. 
A building permit is obtained for this use before construction.
H. 
Surfacing Of Parking Lots. All off-street parking, loading, aisles or maneuvering, entrance and exits shall be at the very minimum hard surfaced with ninety-five percent (95%) compacted base that is a minimum of four (4) inches of crushed rock and covered with a minimum of four (4) inches of Portland cement concrete or asphalt concrete. The applicant shall also consult the Missouri Standard Specifications for Highway Construction (1986 and amendments) and the Division II Construction and Material Specs, Grading and Site Preparation, Paving, Incidental Construction and Seeding and Sodding (APWA Specs Section 2000 through 2400, 1981) and if a higher standard is required in either for the construction of the area, this higher standard shall apply. If a lower standard is set forth in either the Missouri Standard Specifications for Highway Construction (1986 and amendments) or Division II Construction and Material Specs, Grading and Site Preparation, Paving, Incidental Construction and Seeding and Sodding (APWA Specs Section 2000 through 2400, 1981), it shall not apply and the applicant shall follow the minimum standards set forth in this paragraph. All construction shall be in accordance with good general engineering practice.
I. 
Curbing And Drainage. All parking lots and drives leading thereto shall have curbs and drainage facilities approved by the zoning enforcement person, however, "CG-2" curbing, rollback curbs and gutters are specifically prohibited.
1. 
The applicant shall provide drainage structures of sufficient size to handle all drainage.
J. 
Screening. Any off-street parking lot of five (5) or more spaces shall be screened when abutting a residential lot or institutional use and follow the landscaping and screening regulations of this Chapter.
K. 
Lighting. Any off-street parking area providing space for five (5) or more vehicles which are normally used during the hours of darkness (after 6:00 P.M.) shall be provided with lights that provide at least an average of one-fourth (0.25) foot-candle over the entire parking area, measured on the ground surface and arranged to minimize glare to motorists on public streets and to residents of adjoining property.
L. 
Parking Structures. Parking space provided in an enclosed or semi-enclosed structure shall not project beyond any required building line.
M. 
Accessory Use. Off-street parking shall be considered accessory to the use for which the parking is provided. Parking not located on the same tract on which the main use is located must be located within the zoning district in which parking or storage lots are permitted as a main use or be located in accordance with the provisions of this Article relating to off-street parking conditional uses.
N. 
Parking On Right-Of-Way. No parking shall be permitted within (10) feet of a public street right-of-way, except that parking a motor passenger car shall be permitted in customary driveways or single- or two-family dwellings.
O. 
Accessory Area. When parking lots are sparsely used, are highly seasonal in their use or where other special conditions exist, an application shall be presented to the Planning Commission requesting a portion of the parking area be left unimproved until such time as the Board of Aldermen deem it must be improved to adequately serve current parking demands. After review of the application, the Planning Commission shall within ninety (90) days send the application onto the Board of Aldermen for approval or denial. The failure of the Board of Aldermen to act within ninety (90) days shall be deemed a denial of the application. The land so delineated for future parking shall be surveyed by a licensed engineer or surveyor of the State of Missouri with his/her seal firmly affixed upon the plans and specifications of the land which will and can be used for parking in the future. A permit for delayed construction in the parking lot area shall be issued only after the Planning Commission and the Board of Aldermen are satisfied that the initial occupancy of the premises will be adequately served by the lesser number of spaces and only after approval of a final development plan indicating clearly the location, pattern and circulation to and from the initial and the delayed parking spaces.
P. 
Plans And Approval Required. Plans showing the layout and design of all required off-street parking and loading areas shall be submitted to the zoning enforcement person or the Planning Commission. If the permit to be issued is within the "A-1", "R1-40", "R1-16", "R1-8" or "R-2" district, approval shall be at the discretion of the zoning enforcement person. The Planning Commission shall approve all other plans. Before approving any parking layout, the Planning Commission shall confirm that the spaces provided are usable and meet standard design criteria contained herein. In the case of a use for which off-street parking requirements are not specifically enumerated or mentioned, the requirements for off-street parking for a use which is similar shall apply. Similarity is to be determined by the zoning enforcement person. All required off-street parking spaces shall be clearly marked on the plan.
Q. 
Completion. All required construction and improvement of a parking area shall be completed within six (6) months of completion of the building or from the issuance of a building permit (whichever is later). However, at the discretion of the zoning enforcement person, a semi-annual renewal may be automatically granted at any time if requested.
R. 
Occupancy Certificate. All required parking spaces, driving aisles and access streets required by that portion of the building covered by the occupancy permit sought shall be constructed prior to the issuance of any occupancy certificate. No building shall be occupied prior to issuance of an occupancy permit.
S. 
Repair And Service. No motor vehicle repair work or service of any kind shall be permitted in association with any off-street parking facility.
T. 
Expansion Or Change In Use Requires Parking Adjustment. When there is an enlargement to any building to an extent in excess of twenty-five percent (25%) of the floor area of the existing building or structure or there is a change in use of the lot, building or structure, the off-street parking requirements shall meet the requirements of the expanded or new use. In no case shall such a change or expansion of use be permitted that cannot provide the number of off-street parking or loading spaces required in this Article.
U. 
Conditional Use Permit.
1. 
Off-street parking permitted. In order to provide off-street parking areas, the Board of Aldermen may grant a conditional use permit for off-street parking areas when there is a change of use of any existing buildings or structures.
2. 
Permit revocable. The zoning enforcement person shall be responsible for the enforcement of the conditions and requirements made by the Planning Commission or Board of Aldermen in the approval of any off-street parking conditional use. The zoning enforcement person, upon discovery of any violation of this regulation or the conditions and requirements established by the Commission, may notify the Planning Commission and Board of Aldermen of violations. The zoning enforcement person is hereby authorized to revoke any and all permits for the following reasons:
a. 
Abandonment of the area for parking purposes for six (6) months.
b. 
Failure to comply with the requirements contained in this Section or imposed by the Planning Commission or Board of Aldermen.
3. 
Appeal. Appeals for a permit revoked for off-street parking conditional use shall be made to the Board of Zoning Adjustment in accordance with Article XXIX of this Chapter.
V. 
Voluntary Provision. Any off-street parking lot not required by the provisions of these Articles but which is voluntarily provided shall observe all requirements of this Article in the development of such parking area.
W. 
Additional Regulations. The following regulations shall apply:
1. 
All signs thereon shall conform to City ordinance.
2. 
All parking spaces shall be striped with appropriate and durable paint, clearly delineating spaces.
3. 
Additional conditional permit uses. In the event a conditional permit is required by any other provisions of this Chapter, then no provision of this Chapter relative to "A-1", "R1-40", "R-16,"R1-8", "R-2", "R-3", "R-4", "C-1", "C-2", "M-1", "M-2" shall operate to prevent the requirement of such conditional permit. Any conditional permit used in any of the zone areas may require additional regulations, which may be enacted at the time of application.
X. 
How To Measure. When measuring feet from a public street, the measurement shall begin at the front lot line, side lot line or rear lot line. When measuring feet from a parking area to a street, the measurements shall begin at the back of the curb of the parking area.
