Establishment.

There shall be a Department of Public Safety, the supervisor of which
shall be the Director of Public Safety. The Department of Public Safety
shall consist of the following Divisions:

Each of these three divisions shall be organized and carry out the
functions set forth below in this article.

with the Borough of Wharton for the provision of police services within
the Township of Mine Hill.
B.Â
Director of Public Safety. The Director of Public Safety shall be
nominated, and with the advice and consent of the Township Council,
appointed by the Mayor. The Director of Public Safety shall hold office
at the pleasure of the Mayor and Township Council and shall be paid
a salary fixed and adopted by the Township Council annually. The Director
of Public Safety shall possess at the time of appointment such education,
experience, licensing, knowledge and abilities as deemed appropriate
by the Mayor and Council.

Functions of the Department of Public Safety. The Department of Public
Safety shall have, exercise and discharge such functions, powers and
duties as may be provided by Charter and statute and assigned by these
ordinances to its various divisions. The Department will be directed
and supervised by the Director of Public Safety.[3]

Establishment; Fire Chief. There shall be a Division of Fire Protection
within the Department of Public Safety, the head of which shall be
the Fire Chief, who shall be selected and serve for such term as may
be provided by the ordinances of the Township heretofore and hereafter
adopted, general law and the bylaws and regulations of the Volunteer
Fire Department of the Township of Mine Hill. The Volunteer Fire Department
of the Township of Mine Hill as heretofore established and organized
shall constitute this Division of Fire Protection.

Functions of the Division of Fire Protection. The Division of Fire
Protection under the direction and supervision of the Fire Chief and
the Mayor shall be responsible for fire prevention and the control,
fighting and extinguishment of fires which occur within the Township
of Mine Hill.
There shall be a Division of Civil Defense and Disaster Control
within the Department of Public Safety, the head of which shall be
the Director of Civil Defense and Disaster Control, who shall be appointed
by the Mayor with the advice and consent of the Council. The Director
shall serve at the pleasure of the Mayor but not longer than the term
of the Mayor appointing him. The Division of Civil Defense and Disaster
Control and the Director thereof shall have such functions, powers
and duties as provided by general law, ordinances of the Township,
or as may be assigned from time to time by the Mayor or the Director
of Public Safety. The Director of Civil Defense and Disaster Control
shall receive such compensation as shall be fixed annually by ordinance.

There is hereby established a Division of Consumer Affairs within
the Department of Public Safety, the head of which shall be the Director
of Consumer Affairs, who shall be appointed by the Mayor with the
advice and consent of the Council for a term of one year, commencing
January 1. The Director of Consumer Affairs shall receive such compensation
as shall be fixed annually by ordinance.

The Division of Consumer Affairs and the Director shall have such
functions, powers and duties as are provided by the rules, regulations
and procedures of the New Jersey Division of Consumer Affairs and
the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) and other
controlling laws.
