There shall be a Department of Public Works, the head of which shall be the Director of Public Works. The Department of Public Works shall consist of the following divisions:
A. 
Division of Roads;
B. 
Division of Buildings and Grounds;
C. 
Division of Water.

The Director of Public Works shall be appointed by the Mayor with the advice and consent of the Council for the term of the Mayor appointing him (her) until a successor has been appointed and qualified. The Director of Public Works shall receive such compensation as shall be fixed annually by ordinance. The person appointed to the position of Public Works Manager as hereinafter defined and established may but need not be also appointed as Director of Public Works as the Mayor (with the advice and consent of the Council) may determine.

A. 
Establishment of position. The position of Public Works Manager as hereinafter established in § 74-4, Public Works Manager, may, but need not be, appointed Director of the Division of Roads, the Director of the Division of Buildings and Grounds, and the Director of the Division of Water within the Department of Public Works. In the event the same person is appointed by the Mayor (with the advice and consent of the Council) Director of only one or two of these divisions, all the functions, duties and powers of such position shall revert and vest in the Director of Public Works.
B. 
Functions, duties and powers of the Public Works Manager. The Public Works Manager shall be under the direction and supervision of the Director of Public Works. Under such direction and supervision, the Public Works Manager shall supervise and direct the day-to-day operations of the Department of Public Works. In general, the Public Works Manager shall, subject to the overriding control, power and supervision of the Director of Public Works, exercise and discharge such functions, duties and powers as conferred upon and assigned to the Public Works Manager as set forth hereinafter and as more specifically defined in Chapter 74, Public Works, Department of, of the Code of the Township of Mine Hill.
A. 
Generally. The Department of Public Works shall be responsible for operating, maintaining and repairing the roads within the Township for which the Township is responsible, all public buildings, grounds and facilities within the Township which the Township owns or for which it is responsible, and operating and maintaining the Township's water system and facilities and any additional utilities and services which the Township may hereinafter elect to provide to its residents, all as more particularly provided and specified in said ordinance entitled "An Ordinance Establishing a Department of Public Works in the Township of Mine Hill, Morris County, New Jersey," codified as Chapter 74, Public Works, Department of, the provisions of which are hereby reaffirmed and incorporated herein, except as specifically modified hereby or inconsistent herewith. All requirements contained in Chapter 74, Public Works, Department of, regarding reporting to the Township Committee or a committee of the Township Committee, or references to following recommendations and/or directions of the Township Committee, shall hereinafter be interpreted to mean or refer to the Director of the Department of Public Works and the Mayor.
B. 
Division of Roads.

(1) 
The Division of Roads shall be under the direction of the Director of Roads, who shall be the Public Works Manager, if the same person is also appointed (by the Mayor, as aforesaid) the Director of Buildings and Grounds and Director of Water. The Director of Roads shall receive such compensation as shall be fixed annually by ordinance.
(2) 
The Director of Roads shall perform all of the functions relating to roads assigned to the Department of Public Works by said ordinance entitled "An Ordinance Establishing a Department of Public Works in the Township of Mine Hill, Morris County, New Jersey," codified in Chapter 74, Public Works, Department of.
C. 
Division of Buildings and Grounds.

(1) 
The Division of Buildings and Grounds shall be under the direction of the Director of Buildings and Grounds, who shall be the Public Works Manager, if the same person is also appointed (by the Mayor, as aforesaid) Director of Roads and Director of Water. The Director of Buildings and Grounds shall receive such compensation as shall be fixed annually by ordinance.
(2) 
The Director of Buildings and Grounds shall perform all functions relating to buildings and grounds assigned to the Department of Public Works by said ordinance entitled "An Ordinance Establishing a Department of Public Works of the Township of Mine Hill, Morris County, New Jersey," codified as Chapter 74, Public Works, Department of.
D. 
Division of Water.

(1) 
The Division of Water shall be under the direction of the Director of Water, who shall be the Public Works Manager, if the same person is also appointed (by the Mayor, as aforesaid) Director of Roads and Director of Buildings and Grounds. The Director of Water shall receive such compensation as shall be fixed annually by ordinance.
(2) 
The Division of Water shall be organized and function as provided in an ordinance entitled "An Ordinance Establishing a Department of Public Works in the Township of Mine Hill, Morris County, New Jersey," codified in Chapter 74, Public Works, Department of. Specifically, the Division of Water shall perform all of the functions assigned and related to the Division of Water and the Director of Water in Chapter 74, Public Works, Department of, including the requirements that it function and operate as an independent water utility operation.
E. 
Wastewater Operator. There is hereby established the position of Wastewater Operator which shall be filled by an individual meeting all the necessary qualifications, who shall be appointed by the Mayor with the advice and consent of the Council. The Wastewater Operator shall be responsible for the operations of the Township wastewater system and responsible for the filing of all required reports together with such other duties as may be assigned by the Mayor or department head. In lieu of appointing a Wastewater Operator, the wastewater operation services may be provided by contractual arrangements.

The position of Foreman of the Department of Public Works is hereby reestablished and confirmed. The Foreman of the Department of Public Works shall have such duties and responsibilities as more particularly described in said ordinance entitled "An Ordinance Establishing a Department of Public Works in the Township of Mine Hill, Morris County, New Jersey," codified as Chapter 74, Public Works, Department of, except as otherwise provided by or inconsistent with the Charter or this Code.
