There shall be a Department of Planning and Development, the
head of which shall be the Director of Planning and Development, who
shall be appointed by the Mayor with the advice and consent of the
Council for the term of the Mayor appointing him (her) and until a
successor has been appointed and qualified. The Director of Planning
and Development shall receive such compensation as shall be fixed
annually by ordinance. The Construction Official of the Township appointed
pursuant to the State Uniform Construction Code Act (N.J.S.A. 52:27D-119
et seq.) or the Township Zoning Officer may, but need not be, also
appointed Director of Planning and Development.
The Department of Planning and Development and its Director
shall:
A.
Constitute and carry out all the functions, powers and duties of the enforcing agency pursuant to the State Uniform Construction Code Act (N.J.S.A. 52:27D-119 et seq.) and code (regulations) promulgated pursuant thereto and the Township ordinance implementing said Act and code entitled "An Ordinance to Implement the Provisions of the State Uniform Construction Code Act, Chapter 217 of the Laws of 1975 and Regulations Promulgated Pursuant to the Act," codified as Chapter 195, Construction Codes, Uniform, of the Code of the Township of Mine Hill. Specifically, this Department shall carry out all functions, duties and powers conferred upon and assigned to the Township Building Department as the enforcing agency under the implementing ordinance, codified as Chapter 195, Construction Codes, Uniform.
B.
Supervise, coordinate, administer and provide all inspection services
and issue all permits and licenses required pursuant to the State
Uniform Construction Code Act and code and implementing ordinance,
and generally supervise and coordinate the services of the Construction
Official and all subcode officials appointed pursuant to the Act,
code and implementing ordinance.
C.
Supervise, coordinate, administer and provide all zoning inspection and zoning enforcement services and issue all zoning permits and licenses required pursuant to Chapter 310, Land Use, of this Code and the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.), and generally supervise and coordinate all services required of the Zoning Officer of the Township.
D.
Enforce and administer all uniform codes adopted pursuant to the Uniform Construction Code Act and all other laws and ordinances regulating and controlling construction and development within the Township, including Chapter 310, Land Use, of this Code, except for such functions, powers and duties conferred by law upon the Township Planning Board.
E.
Provide administrative staff and other assistance to and coordinate
the functions and operations of this Department with the functions
and operations of the Township Planning Board, Environmental Commission,
Industrial Commission and all other commissions, agencies and boards
of the Township possessing and/or carrying out duties and responsibilities
related to construction, development and planning within the Township.
F.
Except to the extent prohibited by law, supervise the functions of
the Industrial Commission and Environmental Commission.
G.
Advise and assist the Mayor and Council in regard to physical planning
and public improvement aspects of all matters related to the development
of the Township, including the supervision and coordination of the
efforts and services of any professional planner employed by the Township,
except for such matters and functions conferred by law and/or Township
ordinances upon the Township Planning Board.
H.
Conduct studies and collect data regarding the operation and effect
of land use controls and their administration within the Township
and report thereon to the Mayor and Council, except as may be conferred
by law and/or Township ordinances upon the Township Planning Board.
A.
Construction Official; appointment. Pursuant to the State Uniform Construction Code Act (N.J.S.A. 52:27D-119 et seq.) and the ordinance entitled "An Ordinance to Implement the Provisions of the State Uniform Construction Code Act, Chapter 217 of the Laws of 1975 and Regulations Promulgated Pursuant to the Act," codified as Chapter 195, Construction Codes, Uniform, of the Code of the Township of Mine Hill, there shall be a Construction Official responsible for the administration of the construction codes operative within the Township. The Construction Official shall be appointed by the Mayor with the advice and consent of the Council for a term of four years, commencing January 1. Such Construction Official shall possess all the qualifications required of such position by said Act and code. He shall receive such compensation as shall be fixed annually by ordinance.
B.
Subcode officials. The Director of the Department of Planning and
Development, with the approval of the Mayor, shall appoint the Building
Subcode Official, Plumbing Subcode Official, Electrical Subcode Official,
Fire Protection Subcode Official and such other subcode officials
as may be required by law. The terms of all such subcode officials
shall be four years, commencing January 1. Subcode officials shall
receive such compensation as shall be fixed annually by ordinance.
C.
Zoning Officer. There shall be a Zoning Officer, who shall be appointed by the Mayor with the advice and consent of the Council for a term of one year, commencing January 1. The Zoning Officer shall have such zoning functions, duties and powers as are conferred upon the Zoning Officer by Chapter 310, Land Use, of this Code and other ordinances and laws.
D.
Code Enforcement and Housing Officer. There shall be a Code Enforcement
and Housing Officer who shall be appointed by the Mayor with the advice
and consent of the Council for a term of one year, commencing January
1. The Code Enforcement and Housing Officer shall be responsible for
the enforcement of municipal ordinances as well as housing inspections
and certificate of habitability inspections, together with such other
duties as may be assigned by the Mayor or department head.

The Construction Official may also be appointed to one or more
of the subcode official positions, and also as Zoning Officer, provided
he (she) is properly qualified for each position to which he (she)
is appointed.
To the extent permitted by the State Uniform Construction Code
Act and code, the Mayor, with the approval of the Council, may, in
accordance with all other controlling laws, contract with approved
inspection agencies and/or other municipalities for the inspection
services required of the Township pursuant to the Act and code, in
lieu of the appointment and employment by the Township of its own
Construction Official and subcode officials, or any one or more of
such officials.
