As used in this article, the following terms shall have the meanings indicated:
BUILDING
Constitutes a structure in which one or more units are housed.
EQUIVALENT DWELLING UNIT (EDU)
Each unit, whether in a single- or multiple-unit structure, having a demand on the sewer system equal to that of a dwelling unit, which has been determined to be 60,000 gallons per year.

TOWNSHIP
Township of Mine Hill.
UNIT
Consists of a single use, whether residential, commercial, industrial or institutional, except schools, private or public.
Sewer charges shall be made by the Township of Mine Hill and shall be billed to the owners of real property upon which buildings and structures stand in the Township as provided in the Fee Schedule. This charge shall be levied on a calendar-year basis, except that such charges shall be prorated for the first calendar year.

Delinquencies on sewer charges set forth in this chapter shall be charged the same interest from the time they become due as taxes upon real estate in the Township of Mine Hill and shall be a lien upon the premises connected to the sanitary sewers until paid, and the Township of Mine Hill shall have the same remedies for the collection thereof with interest, costs and penalties as it now has by law for the collection of taxes upon real estate. Charges under this chapter levied upon the primary residence of a person who is enlisted in any branch of the United States Armed Forces shall be abated during the period of time in which that person is deployed in active service in time of war.
A. 
The Township of Mine Hill Council shall review the total costs of operation of the sewer system and supporting user charges annually.
B. 
Any user who discharges any toxic pollutants which cause any increase in the cost of managing the effluent of the sludge of the treatment works shall pay for such increased costs.
C. 
All charges for operation and maintenance for all flow not directly attributable to users shall be distributed among all users in the charges for number of hookups per user and in the actual usage charge.
D. 
Each user of the system shall be notified at least annually of the user charges and that portion of the user charges which are attributable to wastewater treatment services.
E. 
This user charge system shall take precedence over any other conditions or agreements between the Township and its users.

A. 
Connection fee.

(1) 
The owner or occupant of a unit who desires or is required to connect said unit to a Township sanitary sewer line for the purpose of the discharge of human and/or processed waste (including only those wastes acceptable pursuant to these regulations or other acceptable requirements of the state, federal or local governments) shall pay a connection fee.
(2) 
The connection fee shall be $7,720 per equivalent dwelling unit (EDU) plus an additional fee of $1,532.25 per equivalent dwelling unit (EDU) for the RVRSA capital contribution charge. An application fee of $75 shall also be paid when an application for connection is submitted.
B. 
Determination of EDU. Each single-family residential unit and each unit in a multifamily residential property shall be one EDU. For all other units, the number of EDUs shall be calculated by dividing the anticipated flow based upon the factors listed below by 60,000 gallons per year and rounded to the next highest whole minimum fee. The design flow rate for various types of uses shall be determined by the Township utilizing the design criteria suggested by the New Jersey Department of Environmental Protection or such other established and reliable sources, including but not limited to N.J.A.C. 7:14A-23.3. The minimum connection fee shall be equivalent to that of a single-family dwelling unit as specified herein.
C. 
Tapping fee. The property owner may be charged any and all actual costs incurred by the Township associated with the connection of the individual property to the public sewer main. There shall be a charge of $600 (or the Township cost) for curb boxes when required for sewer service behind the curb/low pressure sewers.

The annual sewer charge shall be $840 per equivalent dwelling unit (EDU).
A. 
Single-family or multifamily residential, per unit: 1.0 EDU.
B. 
Commercial, office, retail. The number of equivalent units based on the estimated annual flow (number/EDU).
C. 
Industrial. The number of equivalent units based on the estimated annual flow (number/EDU).
D. 
All other uses. The number of equivalent units based on the estimated annual flow (number/EDU).
