No merchant's (liquor, cab, etc.) license may be issued to any person who owes delinquent personal or real property taxes, water bills, or any delinquent obligation to the City of St. Robert.

A. 
No person, firm, co-partnership, association or corporation shall engage in any of the various businesses, employments, occupations, agencies, amusements, or exhibitions, as own, manage, operate or control any public building, public halls, or any other of the matters and things hereinafter listed unless such person, firm, co-partnership, association, or corporation shall first apply to the City Clerk for a license. If the City Clerk is convinced that the applicant has complied with any and all ordinances governing the issuance of a license to do or engage in the matter of things for which said license is applied for shall issue to said applicant a license upon the payment of the proper license fee as set out in Section 615.150.
B. 
A license shall be required of every business when the same be reasonably within the intention of the Legislature of this State in the enactment of Section 94.270, RSMo., and other State Statutes.

No business license shall be issued pursuant to this Chapter unless the application for such license is accompanied by a tax receipt or statement certified by the City Collector showing that the City's tangible personal property tax and real estate taxes for the preceding years have been paid by the applicant or that no such taxes were done. Any unpaid taxes must be paid in full by the applicant before such fees can be paid and such license issued.

No business license will be issued pursuant to this Chapter unless the applicant has obtained a State Sales Tax Number where applicable and the Sales Tax Number will be recorded on license where applicable.

All license tax shall be regulated by ordinance, and no license shall be issued until the amount prescribed therefor shall be paid to the City Collector, and no license shall in any case be assigned or transferred. Licenses shall be signed by the Mayor and City Clerk and counter-signed by the City Collector, and the Clerk shall affix the Corporate Seal thereto.

No license granted hereunder shall be transferable and no part of such fee shall be refunded whether there is a transfer of the business or not. The fee for licenses issued after January first (1st) for a new business shall be the full license fee.

All licenses herein provided for shall be due and payable on January 1 hereafter, and shall expire on December 31, following the date of issuance, and shall be renewed annually. Any business who has failed to renew their license will after January 15 be charged an additional license fee of five dollars ($5.00) per day to a maximum additional license fee of twenty-five dollars ($25.00).

Where there is more than one (1) business within or under the same roof, general vicinity, or the business is owned by the same person(s), firm, corporation and association there must be a license for each separate business or one (1) license with a cost equal to businesses within.

No business license will be issued or transferred pursuant to this Chapter unless the applicant has complied with the St. Robert Zoning Ordinance and Business Regulation.

It shall be the duty of the City Collector to collect all monies for businesses issued under this Chapter and keep an accurate register of all licenses issued under the provisions of this Chapter in such a form as will clearly show what licenses are in force, to whom issued, the businesses for which issued and the amount paid.

It shall be the duty of the City Collector to provide the Chief of Police a list of all businesses who have failed to renew licenses by the last day of January. Upon receipt of the list, the Chief of Police will cause a summons to be issued.

It shall be the duty of the City Clerk to check all business licenses issued against the State Sales Tax Record, and where businesses are found not reported the City Clerk will ensure that the business information is sent to the Director of Revenue so the business can be added where applicable.

Except as may be provided otherwise by this Chapter no license shall be required of any person for mere delivery in the City of St. Robert of any property purchased or acquired in good faith from such person at his/her regular place of business outside the City.
A. 
Hereafter no person following for a livelihood the profession or calling of minister of the gospel, duly accredited Christian Science practitioner, teacher, professor in a college, priest, lawyer, certified public accountant, dentist, chiropractor, optometrist, chiropodist, or physician or surgeon in this City, shall be taxed or made liable to pay any municipal or other corporation tax or license fee of any description whatever for the privilege of following or carrying on such profession or calling, any law, ordinance or charter to the contrary notwithstanding.
B. 
No person following for a livelihood the profession of insurance agent or broker, veterinarian, architect, professional engineer, land surveyor, auctioneer, or real estate broker or salesman in this City, shall be taxed or made liable to pay any municipal or other corporation tax or license fee for the privilege of following or carrying on his/her profession unless that person maintains a business office within the City of St. Robert.

A. 
The following definitions are to be utilized in this Section:
SEASONAL MERCHANT
Any person doing business in this City who shall make sales, wholesale or retail, of any goods, wares or merchandise from any store, stand or place occupied for a period of time not to exceed ninety (90) days.
TEMPORARY MERCHANT
Any person doing business in this City who shall make sales, wholesale or retail, of any goods, wares or merchandise from any store, stand or place occupied for a period of time not to exceed thirty (30) days.
B. 
Any person desiring to provide temporary or seasonal sales or services shall file an application with the City Clerk's office for approval. The application shall contain all pertinent information as required by the City, including the sales tax number of the business, the nature of the proposed sales or services, and the dates of operation. Each business required to have a sales tax number must use a cash register to register all sales therefore.
C. 
Such applications may be approved by the City Administrator or his or her designee, if the applicant complies with the following regulations:
1. 
The proposed temporary or seasonal usage must be in compliance with all applicable St. Robert zoning regulations.
2. 
Written permission of the property owner or property manager for the specific dates and locations must be filed with the application.
3. 
Receipt of a copy of a sales tax license for the use issued by the State of Missouri.
D. 
Upon approval of the application, the applicant shall pay to the City of St. Robert a business license fee of twenty-five dollars ($25.00).
E. 
A seasonal merchant may extend the time that they originally applied for, up to an additional ninety (90) days, for an added twenty-five dollars ($25.00). They must also provide a letter from the property owner or property manager for the specific dates and locations.

Any person violating the terms of this Chapter or refusing or failing to obtain a license as herein provided for shall be deemed guilty of a misdemeanor, and upon conviction shall be fined a sum of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) and costs, provided however, that such conviction shall not relieve such party from being required to obtain and pay for a license as above required to obtain and pay for a license as above required, and a continued failure or refusal shall constitute a new and separate offense for each day party fails to obtain license for which such party may be prosecuted.

It shall be the duty of the Chief of Police after January thirty-first (31st) of each year to cause a check of each business within the City of St. Robert to insure that a business has obtained a current license and to issue a summons for those persons failing to comply with this Chapter.

A. 
All applicants for an occupational, business, or merchants license to conduct a business in the City of St. Robert, Missouri shall be required to submit a certificate of insurance for Workers' Compensation coverage, covering said applicant's liability pursuant to Chapter 287, RSMo.
B. 
Any applicant who fails to comply with this Section shall be denied such a license until said applicant furnishes a certificate of insurance.
C. 
It shall be unlawful, and a violation of this Section, and punishable as any and all other violations of ordinances in the City of St. Robert for any applicant to provide fraudulent information pursuant to this Section.
D. 
Nothing in this Section shall be construed to create or constitute a liability to or a cause of action against the City of St. Robert in regard to the issuance of any license pursuant to this Section.
E. 
Any applicant who claims that the applicant is not required to have Workers' Compensation coverage pursuant to Chapter 287, RSMo., shall provide to the City of St. Robert with an Affidavit to that effect prior to the issuance of any license.
