The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
ABANDONED MOTOR VEHICLE OR OTHER PERSONAL PROPERTY
A motor vehicle or other personal property which remains on the streets or other public property for more than forty-eight (48) hours, the owner of which cannot be located, or if located, owner refuses to remove the same immediately.
UNIDENTIFIED MOTOR VEHICLE OR OTHER PERSONAL PROPERTY
A motor vehicle or other personal property, ownership of which cannot be ascertained.

No person owning or in charge of a motor vehicle or other personal property shall leave or abandon the same upon the streets or upon any public place in the City.

A. 
Members of the Police Department are herewith authorized to remove a vehicle or other personal property to the nearest garage, lot or storage area designated by the Chief of Police, at cost to the owner thereof, including daily storage charges, when:
1. 
Any vehicle upon a street is so disabled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle or other property are by reason of physical injury or condition, incapacitated to such an extent as to be unable to provide for its custody or removal.
2. 
Any vehicle or other personal property is parked illegally or placed in such a manner as to constitute a definite hazard or obstruction to the movement of traffic.
3. 
A vehicle parked on the street in the same place continuously for forty-eight (48) hours.
4. 
The driver of any vehicle is taken into custody by the Police Department and such vehicle would thereby be left unattended upon a street or roadway, or illegally parked, and when, if there be another person in such vehicle, said person would not be considered by the arresting officer as legally entitled to move such vehicle or said vehicle is in violation of a State or City law, and the operation thereof would in itself be a violation of such.
5. 
Any vehicle is found being driven on the streets and is not in proper condition to be driven.
6. 
Any vehicle is parked on private property or upon an area developed as an off-street parking facility without the consent and upon the complaint to the Police Department of the owner, lessee or person in charge of any such vacant property or facility.
7. 
Any vehicle or personal property is directly interfering with the maintenance and care or emergency use of the streets by any proper department of the City.
8. 
Any vehicle is left unattended without first stopping the engine, locking ignition, removing key, and setting brake.
9. 
Any vehicle is parked on the streets or any public place without license plates or with license plates reported stolen.
10. 
Any unidentified, stolen, wrecked, or abandoned motor vehicle or other personal property is found upon the public street.

Whenever an officer removes a vehicle from a street as authorized in this Article and the officer knows or is able to ascertain from the registration records the name and address of the owner thereof, such officer shall immediately give or cause to be given, notice in writing to such owner of the fact of removal, the reasons therefor and of the place to which such vehicle has been removed.

The Police Department is directed to inventory all vehicles and personal property removed and/or impounded as provided in this Article.

A. 
The City of Grain Valley, Missouri, shall be empowered to sell any abandoned or seized vehicle after a period of thirty (30) days from the date of towing and/or storage of said vehicle by means of a "Bill of Sale" signed by the City Clerk and sealed with the official Municipal Seal. Such "Bill of Sale" shall contain the make and model of the vehicle, the complete vehicle identification number and the odometer reading of the vehicle and shall be lawful proof of ownership for any dealer or person under the provisions of Section 304.155, RSMo.
B. 
Prior to any such sale or disposition, the Grain Valley, Missouri, Police Department shall send a registered letter to the owner and/or lienholder of any such vehicle, stating the date of intended sale thereof, and allowing the owner and/or lien holder to recover said vehicle within ten (10) days of the receipt of said registered letter, upon payment of all tow and storage charges to the City of Grain Valley, Missouri. In the event such registered letter is returned without delivery, the City of Grain Valley, Missouri, shall not be further liable and the requirements of this Section and Section 301.155, RSMo., shall have been deemed to have been met.
