The owners of all homes, properties, or structures used or intended
to be used for human occupancy, employment, recreation, or such other
purposes, which are located within 100 feet of any waterline or water
main which is part of the Town of Lonaconing water system, shall be
required at the property owner's expense to connect to such water
main or waterline in accordance with provisions of this article within
90 days of the date on which official notice of the availability of
such water services is made known to said owners by mail from the
Mayor and Town Council of Lonaconing, provided that such water system
is available for such connection as contemplated therein.
All connections to said waterlines shall be in accordance with the specifications promulgated by the Mayor and Town Council of Lonaconing, and said specifications shall be supplied to the owners of said property with the notice provided for in § 226-1 above.
Any property owner not complying with this article shall be
subject to the following:
A.Â
The requirement to pay the minimum fee for water services, to the
same extent as if said property were connected to the waterline, and
failure to pay shall be considered a lien upon the property in the
same manner as any other unpaid water bill.
B.Â
The Town filing a petition in the Circuit Court for Allegany County,
Maryland, compelling connection to the water system and an order of
cease and desist from the use of any private well, private water system,
or other water supply which may possibly cross-contaminate the public
water system of the Town of Lonaconing.
C.Â
A fine or penalty in an amount in accordance with rules and regulations
established by the Mayor and Council from time to time to enforce
this article.
