The provisions of this chapter are adopted by the Town of Herman pursuant to the authority granted by §§ 60.62, 61.35 and 62.23(7), Wis. Stats.
This chapter is adopted for the following purposes:
A. 
To promote and protect the public health, safety, morals, comfort, convenience and general welfare.
B. 
To minimize congestion in the public rights-of-way, promote safety from natural and man-made disasters, provide for adequate light and air, and avoid undue concentration of population.
C. 
To facilitate the adequate, efficient and cost-effective provision of public services and facilities.
D. 
To encourage the use of lands and natural resources in accordance with their character and adaptability by utilizing special land features, such as slope, topography, soils, vegetation, wetland areas and wildlife.
E. 
To conserve the natural scenic beauty and attractiveness of the Town and to enhance the aesthetic desirability of the environment.
F. 
To divide the Town into districts within which the location, sizes and uses of buildings and minimum open spaces shall be regulated.
G. 
To prohibit the use of buildings, structures and lands that are incompatible with the intended use or development of lands within the specified districts.
H. 
To provide regulations pertaining to preexisting lots, structures and uses that do not conform to provisions of this chapter.
I. 
To provide for the compatible and appropriate use of land throughout the Town.
J. 
To provide for the administration of this chapter and its amendments.
K. 
To prescribe penalties for the violation of provisions of this chapter or any of its amendments.[1]

It is not intended by this chapter to repeal, abrogate, annul, impair, or interfere with any existing easements, covenants, deed restrictions, agreements, ordinances, rules, regulations or permits previously adopted or issued pursuant to law. However, wherever this chapter imposes greater restrictions, the provisions of this chapter shall govern.
The provisions of this chapter shall be interpreted and applied as minimum requirements, shall be liberally construed in favor of the Town, and shall not be deemed a limitation or repeal of any other power granted by the Wisconsin Statutes.
This chapter shall be known as, referred to or cited as the "Town of Herman Zoning Ordinance."
The power to adopt a Town zoning ordinance having been approved by referendum vote of the electors of the Town held at the time of a regular annual Town meeting and a public hearing having been held regarding this chapter following the giving of requisite notice, the adoption by the Town Board of the original ordinance was named effective following approval by the Dodge County Board of Supervisors and publication.[1]
